SENATE BILL NO. 323

FUNDS/FUNDING.  Dedicates monies in the Deepwater Horizon Economic Damages
Collection Fund for certain infrastructure projects. (7/1/20)
1	AN ACT
2 To amend and reenact R.S. 39:91(B)(6), to enact R.S. 39:91(B)(5)(k) through (kk), and to
3 repeal R.S. 39:91(B)(5)(g), relative to the Deepwater Horizon Economic Damages
4 Collection Fund; to provide for the use of monies in the Deepwater Horizon
5 Economic Damages Collection Fund for certain infrastructure projects; to provide
6 for an effective date, and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 39:91(B)(6) is hereby amended and reenacted, and R.S.
9 39:91(B)(5)(k) through (kk) are hereby enacted, to read as follows:
10 ยง91. Deepwater Horizon Economic Damages Collection Fund

12	B. All economic damages proceeds from the DWH litigation in excess of the
13 first two hundred million dollars deposited in the Fiscal Year 2015-2016 Deficit
14 Elimination Fund shall be deposited by the treasurer as follows:
15	(1)	*          *          *

17	(5) Beginning July 1, 2020, and each fiscal year thereafter through and

1 including Fiscal Year 2034, in such amounts as remain after payment of amounts due
2 on bonds and related expenses as provided in the documents pursuant to which bonds
3 were issued under the provisions of this Section, the state treasurer shall immediately
4 transfer the annual payments of fifty-three million three hundred thirty-three
5 thousand three hundred thirty-three dollars to the Construction Subfund of the
6 Transportation Trust Fund. The economic damage proceeds shall be used, and the
7 bonds issued by the State Bond Commission pursuant to this Section shall be issued,
8 after paying the costs associated with the issuance of the bonds, solely and
9 exclusively for the following projects and in the following amounts:

23 through (kk) of this Paragraph.

25 Section 2. The provisions of R.S. 39:91(B)(5)(g) are hereby repealed.
26 Section 3.  This Act shall become effective on July 1, 2020. If vetoed by the governor
27 and subsequently approved by the legislature, this Act shall become effective on
28 July 1, 2020.

Present law provides that beginning July 1, 2020, and each year thereafter through and
including Fiscal Year 2023, after any debt service is paid for bonds issued pursuant to
present law, the treasurer shall transfer the annual payments of $53,333,333 to the
Construction Subfund of the Transportation Trust Fund (TTF).  The economic damage
proceeds and the bond proceeds, if any, are to used for the following projects:
(1) For Fiscal Years 2021-2026, $25,000,000 per year for 
Phase Two of the LA 1 Improvement Project between 
Golden Meadow and Leeville	$150,000,000
(2)LA 415 Bridge at the Intracoastal Canal	$125,000,000
(3)I-49 South	$150,000,000
(4)La. Hwy. 3241 from I-12 to Bush, La.	$50,000,000
