CLERKS OF COURT.  Provides relative to fees charged by clerks of court for real estate
mortgage certificates and lien certificates.  (2/3 - CA7s2.1(A)) (8/1/20)
1	AN ACT
2 To amend and reenact R.S. 13:844(A)(3), relative to fees charged by clerks of court; to
3 provide for fees charges for real estate mortgage certificates and lien certificates, and
4 to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:844(A)(3) is hereby amended and reenacted to read as follows:
7 ยง844. Fees of ex officio recorders

9	(3) For certificate of real estate mortgage and lien certificate with seal, for
10 each name in which search is made for ten years, and for one definable property
11 only, twenty thirty dollars for the first name and ten twenty dollars for each
12 additional name. For certificate of real estate mortgage and lien certificate with
13 seal, for each name in which search is made for twenty years, and for one
14 definable property only, forty dollars for the first name and twenty dollars for
15 each additional name. For certificate of real estate mortgage and lien certificate
16 with seal, for each name in which search is made for thirty years, and for one
17 definable property only, fifty dollars for the first name and twenty dollars for

1 each additional name. For certificate of real estate mortgage and lien certificate
2 with seal, for each name in which search is made for forty years or more, and
3 of one definable property only, sixty dollars for the first name and twenty
4 dollars for each additional name. There shall be an additional charge of one dollar
5 per exception in the event that more than ten exceptions are contained on a
6 certificate.

Present law, relative to fees charged by clerks of court as ex officio recorders of mortgages,
requires a fee for certificate of real estate mortgage and lien certificate with seal, for each
name in which search is made, and for one definable property only, $20 for the first name
and $10 for each additional name. Requires an additional charge of one dollar per exception
in the event that more than 10 exceptions are contained on a certificate.
Proposed law provides:
(1)For certificate of real estate mortgage and lien certificate with seal, for each name
in which search is made for 10 years, and for one definable property only, $30 for
the first name and $20 for each additional name.
(2)For certificate of real estate mortgage and lien certificate with seal, for each name
in which search is made for 20 years, and for one definable property only, $40 for
the first name and $20 for each additional name.
(3)For certificate of real estate mortgage and lien certificate with seal, for each name
in which search is made for 30 years, and for one definable property only, $50 for
the first name and $20 for each additional name.
(4)For certificate of real estate mortgage and lien certificate with seal, for each name
in which search is made for 40 years or more, and of one definable property only,
$60 for the first name and $20 each additional name.
Proposed law deletes requirement of an additional charge of one dollar per exception in the
event that more than 10 exceptions are contained on a certificate
