SENATE BILL NO. 379

CLERKS OF COURT.  Provides relative to local funding of the clerk of court's office of the
Criminal District Court in Orleans Parish. (6/15/20)
1	AN ACT
2 To amend and reenact R.S. 13:1381.7(A), relative to courts and judicial procedure; to
3 provide relative to the Orleans Parish Criminal District Court; to provide relative to
4 the office of the clerk of court; to provide relative to local funding; and to provide
5 for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 13:1381.7(A) is hereby amended and reenacted to read as follows:
8	A. The legislature finds that adequate funding of the office of Clerk of the
9 Criminal District Court for the parish of Orleans is necessary for the efficient
10 performance of the powers and duties required of a judicial officer of the state.
11 Pursuant to the exercise of the police power of the state, actions for obtaining
12 adequate funding are necessary to promote judicial efficiency and to protect and
13 promote the lives, health, morals, comfort, and general welfare of people as a whole.
14 The amounts to be appropriated and paid by the city of New Orleans for expenses,
15 including salaries and maintenance of constitutional officers, their deputies,
16 subordinates, and employees shall not be reduced by the city of New Orleans without
17 the consent of the legislature.

2 Section 2. This Act shall become effective on June 15, 2020.

Present law provides that amounts paid by the city of New Orleans for expenses, including
salaries and maintenance of constitutional officers, their deputies, subordinates, and
employees, to adequately fund the office of the clerk of the Criminal District Court for
Orleans Parish are necessary for the efficient performance of the powers and duties required
of a judicial officer of the state and prohibits reduction of these amounts by the city without
the consent of the legislature.
Present law provides that existing law is not to be construed as granting the city any rights,
powers, authority, or jurisdiction over any constitutional officers, their deputies, employees,
subordinates, or over any state or district officers, their deputies, subordinates, or employees.
Proposed law retains present law and removes the mandate that prohibits the reduction
amounts paid by the city of New Orleans for expenses, including salaries and maintenance
of constitutional officers, their deputies, subordinates, and employees, to adequately fund
the office of the clerk of the Criminal District Court for Orleans Parish without the consent
of the legislature.
Effective June 15, 2020.
