SENATE BILL NO. 430

PUBLIC LANDS.  Authorizes the transfer of certain state property in Jefferson Parish.

1	AN ACT
2 To authorize and provide for the transfer of certain state property; to authorize the transfer
3 of certain state property in Jefferson Parish; to provide for the property description;
4 to provide for reservation of mineral rights; to provide terms and conditions; to
5 provide an effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  The commissioner of administration, notwithstanding any other provision
8 of law to the contrary, is hereby authorized and empowered to convey, transfer, assign, lease,
9 or deliver any interest, excluding mineral rights, the state may have to all or any portion of
10 the following described parcel of property to the Richard's Real Estate Properties, LLC:
11	One certain lot of ground situated in the Parish of Jefferson, city of Grand
12 Isle, State of Louisiana, located in Section 26, Township 22 South, Range 24 East
13 and described as follows; Beginning at a point, which point is at the intersection of
14 the Southeasterly Right of Way of LA Highway 1 and the Southwesterly Property
15 Line of Lot 6 of Block 1 Plan of A. Bourgerol Survey dated September 20, 1841,
16 thence proceeding along said Southwesterly property line of Lot 6 of Block 1 Plan
17 of A. Bourgerol Survey dated September 20, 1841 at a bearing of North 46°30'00"
18 West for a distance of 177.00 feet to a point, which point shall also be designated as
19 the "Point of Beginning", thence proceeding at a bearing of North 62°33'52" East for
20 a distance of 42.32 feet to a point, thence proceeding at a bearing of North 53°10'51"
21 East for a distance of 20.29 feet to a point, thence proceeding at a bearing of South
22 46°30'00" East for a distance of 102.43 feet to a point, thence proceeding at a bearing
23 of South 43°36'17" West for a distance of 60.00 feet to a point, thence proceeding
24 at a bearing of North 46°30'00" West for a distance of 119.55 feet to a point, which

1 point is the "Point of Beginning". Said property is designated as "Proposed Lease
2 Area" and is fully shown on a plat prepared by Delta Coast Consultants, LLC, dated
3 November 2, 2016, and titled "Proposed Lease from the State of Louisiana Adjacent
4 to Lot 6 and Southwest half of Lot 5, Block 1 Plan of Bourgerol Survey Dated Sept.
5 20, 1841, Property of Farquhard Chauvin, Claude R. Bonie, and Freddie P. Dupre,
6 Located in Section 26, T22S-R24E Jefferson Parish, Louisiana".

8 Said Lot has an area of 6,589 square feet and is bounded in a Northwesterly direction
9 by Lots 6 and the Southwest half of Lot 5, Block 1 Plan of A. Bourgerol Survey
10 dated September 20, 1841, in an Northeasterly, Southeasterly and Southwesterly
11 directions by property owned by the State of Louisiana, together with all buildings
12 and improvements thereon and all rights, ways, privileges and servitudes thereto
13 belonging or in anywise appertaining.

15 Section 2.  The commissioner of administration is hereby authorized to enter into
16 such agreements, covenants, conditions, and stipulations and to execute such documents as
17 necessary to properly effectuate any conveyance, transfer, assignment, lease, or delivery of
18 title, excluding mineral rights, to the property described in Section 1 of this Act, and as more
19 specifically described in any such agreements entered into and documents executed by and
20 between the commissioner of administration and the Richard's Real Estate Properties, LLC,
21 in exchange of consideration proportionate to the appraised value of the property.
22 Section 3.  This Act shall become effective upon signature by the governor or, if not
23 signed by the governor, upon expiration of the time for bills to become law without signature
24 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
25 vetoed by the governor and subsequently approved by the legislature, this Act shall become
26 effective on the day following such approval.
