SENATE BILL NO. 442

SCHOOLS.  Requires implementation of a traumatic injury response program in all public
schools. (gov sig)
1	AN ACT
2 To enact R.S. 17:410.1 and 3996(B)(59), relative to school safety; to provide for a traumatic
3 injury response programs in all public schools; to require bleeding control kits; to
4 require employee training relative to traumatic injury response; and to provide for
5 related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 17:410.1 and 3996(B)(59) are hereby enacted to read as follows:
8 §410.1.  Traumatic injury response; bleeding control kits; requirement;
9	training; limitation of liability
10	A. Each city, parish, or other local public school board shall develop and
11 implement a traumatic injury response program at each school under its
12 authority. The program shall require that:
13	(1) Bleeding control kits are placed in easily accessible locations in
14 designated rooms in each school.
15	(2) The use of bleeding control kits is incorporated into each school's
16 emergency plans and that all school drills include practice on how to use the
17 kits.

1	(3) Each school designate and train employees who are reasonably
2 expected to respond to traumatic injuries and use a bleeding control kit.
3	(4) Each bleeding control kit is annually inspected to ensure that the kit
4 contains all materials as provided in Subsection B of this Section and that all
5 materials are in workable order and are not past the marked expiration dates.
6	(5) The bleeding supply kit is inspected and restocked after each use.
7	B.(1) A bleeding control kit shall, at a minimum, contain the following:
8	(a) One tourniquet.
9	(b) One compression bandage.
10	(c) One bleeding control bandage.
11	(d) Protective latex-free gloves.
12	(e) One marker.
13	(f) One pair of scissors.
14	(g) Instructional documents such as those developed by the "Stop the
15 Bleed" national awareness campaign of the United States Department of
16 Homeland Security or the American College of Surgeons Committee on
17 Trauma.
18	(2) A bleeding control kit may contain other materials and equipment
19 similar to the items listed in Paragraph (1) of this Subsection, and any items
20 that adequately treat a traumatic injury that can be stored in a readily available
21 kit.
22	C. The state Department of Education shall develop and offer training
23 on the response to traumatic injuries and the use of bleeding control kits.
24	D. A person acting in good faith who, pursuant to the provisions of this
25 Section, administers aid for a traumatic injury through the use of a bleeding
26 control kit shall be immune from criminal and civil liability for the
27 administration, unless personal injury results from the gross negligence or
28 willful or wanton misconduct in the administration of the drug.

1 §3996. Charter schools; exemptions; requirements

3	B. Notwithstanding any state law, rule, or regulation to the contrary and
4 except as may be otherwise specifically provided for in an approved charter, a
5 charter school established and operated in accordance with the provisions of this
6 Chapter and its approved charter and the school's officers and employees shall be
7 exempt from all statutory mandates or other statutory requirements that are
8 applicable to public schools and to public school officers and employees except for
9 the following laws otherwise applicable to public schools with the same grades:

11	(59) Traumatic injury response program, R.S. 17:410.1.

13 Section 2.  This Act shall become effective upon signature by the governor or, if not
14 signed by the governor, upon expiration of the time for bills to become law without signature
15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
16 vetoed by the governor and subsequently approved by the legislature, this Act shall become
17 effective on the day following such approval.

Proposed law provides for each city, parish, or other local public school board to establish
a traumatic injury response program which requires training and preparation for traumatic
injuries at each public school. Additionally requires bleeding control kits to be placed in
easily accessible locations in designated rooms at each school and provides for the items
which shall be included in a bleeding control kit.
Proposed law provides for immunity for certain persons who administer aid to traumatic
injuries through the use of bleeding control kits. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
