SENATE BILL NO. 478

MUNICIPALITIES.  Provides relative to the annexation of property by the city of Baton
Rouge. (8/1/20)
1	AN ACT
2 To enact R.S. 33:172.4, relative to annexation of property by municipalities; to provide for
3 annexation of property by the city of Baton rouge; and to provide for related matters.
4	Notice of intention to introduce this Act has been published.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 33:172.4 is hereby enacted to read as follows: 
7 ยง172.4. City of Baton rouge; authority to annex
8	A. Notwithstanding any law to the contrary and in addition to the
9 authority granted by this Part, the governing authority of the city of Baton
10 Rouge may, in the manner provided in this Part, annex property owned by
11 Exxon Mobil Corporation, based on petition with the written consent of the
12 owners of a majority of the acreage or square footage of the property to be
13 annexed together with the written assent of the owners of the property in the
14 area equal in value to at least twenty-five percent of the value of the property
15 to be annexed whenever there are no resident owners or registered voters
16 residing in the area proposed to be annexed.
17	B. As used in the Section, "owners" includes corporations, limited

1 liability companies, limited liability partnerships, and all other legal entities
2 recognized by the laws of the state.
3	C. This Section shall be deemed and construed to be an additional grant
4 of authority to the city of Baton Rouge to annex property when there are no
5 resident owners or registered voters residing in the area to be annexed.
6	D. Nothing in the Section shall be deemed or construed to limit or
7 restrict the existing authority of the city of Baton Rouge to annex property.

Present law provides procedures for the annexation of property by municipalities.
Proposed law, retains present law and adds for the city of Baton Rouge the authority to
annex property owned by Exxon Mobil Corporation, based on petition with the written
consent of the owners of a majority of the acreage or square footage of the property to be
annexed together with the written assent of the owners of the property in the area equal in
value to at least 25% of the value of the property to be annexed whenever there are no
resident owners or registered voters residing in the area proposed to be annexed.
Proposed law defines "owners" to include corporations, limited liability companies, limited
liability partnerships, and all other legal entities recognized by the laws of the state.
Proposed law is to be deemed and construed to be an additional grant of authority to the city
of Baton Rouge and not to limit or restrict the existing authority of the city.
Effective August 1, 2020.
