SENATE BILL NO. 483

HEALTH CARE.  Provides relative to the licensure of hospice providers. (8/1/20)
1	AN ACT
2 To enact R.S. 40:2183(C), relative to the licensure of hospice providers, to provide for
3 recommendation by the Palliative Care Interdisciplinary Advisory Council; to
4 provide for approval by the Centers for Medicare and Medicaid Services; to provide
5 for minimum standards; to provide for rulemaking; and to provide for related
6 matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 40:2183(C) is hereby enacted to read as follows: 
9 ยง2183. Licensure required; transferability of license; fees; moratorium

11	C. Upon recommendation of the Palliative Care Interdisciplinary
12 Advisory Council created pursuant to R.S. 40:2018.6 and approval by the
13 Centers for Medicare and Medicaid Services, the department may proceed with
14 rulemaking in accordance with the Administrative Procedure Act to expand the
15 minimum requirements for hospice licensure to include eligible participants
16 that have not been given a terminally ill diagnosis.

Present law provides for the licensure of hospice providers for the provision of care for
terminally ill patients. Proposed law retains present law and allows the Louisiana
Department of Health to proceed with rulemaking to expand the minimum requirements for
hospice licensure to include eligible participants that have not been given a terminally ill
diagnosis upon recommendation of the Palliative Care Interdisciplinary Advisory Council
created pursuant to R.S. 40:2018.6 and approval by the Centers for Medicare and Medicaid
Services.
