(gov sig) 1 AN ACT 2 To amend and reenact R.S. 40:1046(G), relative to the licensure of therapeutic marijuana 3 dispensing pharmacies; to repeal the limitation on the number of licenses issued; to 4 provide for an effective date; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 40:1046(G) is hereby amended and reenacted to read as follows: 7 ยง1046. Recommendation of marijuana for therapeutic use; rules and regulations; 8 Louisiana Board of Pharmacy and the adoption of rules and 9 regulations relating to the dispensing of recommended marijuana for 10 therapeutic use; the Department of Agriculture and Forestry and the 11 licensure of a production facility 12 * * * 13 G. The Louisiana Board of Pharmacy shall develop an annual, 14 nontransferable specialty license for a pharmacy to dispense recommended 15 marijuana for therapeutic use and shall not limit the number of such licenses granted 16 in the state. to no more than ten licensees. This Act shall become effective upon signature by the governor or, if not 4 signed by the governor, upon expiration of the time for bills to become law without signature 5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 6 vetoed by the governor and subsequently approved by the legislature, this Act shall become 7 effective on the day following such approval. DIGEST SB 501 Original 2020 Regular Session Connick Present law provides that the Louisiana Board of Pharmacy shall develop an annual, nontransferable specialty license for a pharmacy to dispense recommended marijuana for therapeutic use and limits the number of licenses to no more than 10. Proposed law removes the limitation on the maximum number of licenses that the board may issue. Present law provides that the Louisiana Board of Pharmacy shall develop rules and regulations regarding the geographical locations of dispensing pharmacies in Louisiana. Proposed law repeals present law. Effective upon signature of the governor or lapse of time for gubernatorial action.
