(8/1/20) 1 AN ACT 2 To enact R.S. 38:2212.1(C)(3) and (4), relative to letting of contracts for the purchase of 3 concrete; to provide for solicitation specifications for the purchase of concrete; to 4 provide for definitions; to provide for the regulations and implementations for the 5 purchase of concrete; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 38: 2212.1(C)(3) and (4) is hereby enacted to read as follows: 8 ยง2212.1. Advertisement and letting to lowest responsible bidder; materials and 9 supplies; exemptions 10 * * * 11 C. 12 * * * 13 (3)(a) When letting contracts for the purchase of concrete on behalf of 14 facilities, transportation authorities, and institutions of the state, solicitation 15 specifications of the department of public works and any other agency, 16 department, office, board or commission shall require provisions granting 17 preferential selection in competitive solicitations to concrete mix design utilizing Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. The 2 selection standards are governed by a review of the specific concrete mix design. 3 In addition to meeting the American Association of State Highway and 4 Transportation Officials' specification, concrete utilizing portland cement with 5 a maximum clinker factor of eighty-five percent must meet or exceed 6 engineering performance standards approved by the state. 7 (b) "Concrete" as used in this Subsection shall mean structural and non- 8 structural masonry and ready mix concrete building products. 9 (c) "Portland cement" as used in this Subsection shall mean hydraulic 10 cement made by finely pulverizing the clinker produced by calcining to 11 incipient fusion a mixture of clay and limestone or similar materials. 12 (d) "Maximum clinker factor" as used in this Subsection shall mean the 13 maximum amount of clinker utilized in the production of portland limestone 14 cement. 15 (4)(a) The department of public works shall issue regulations for the 16 implementation of this Subsection, including but not limited to: 17 (b) Establishing guidelines that will assist agencies in determining which 18 contracts meet the requirements of this Subsection. 19 (c) Publishing purchasing guidelines on the department of public works' 20 website, disseminating these guidelines to agencies and training contracting 21 personnel on implementing the guidelines. 22 (d) Providing for monitoring of implementation. 23 * * * The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Xavier I. DIGEST SB 502 Original 2020 Regular Session Connick Proposed law provides that when letting contracts, solicitation specifications of the dept. of public works shall require provisions granting preferential selection to concrete mix design utilizing portland cement with a maximum clinker of 85%. Further provides that specifications must meet engineering performance standards approved by the state. Proposed law provides that the dept. of public works shall issue regulations for the implementation of this Subsection which shall include but not be limited to establishing guidelines to determine which contracts meet requirements, publishing purchasing guidelines on the Dept. of Public Works website and providing monitoring implementation.
