SENATE BILL NO. 511

COURTS.  Suspends certain legal requirements as a result of emergency health measures
relative to the COVID-19.  (gov sig)
1	AN ACT
2 To enact R.S. 13:10.5, relative to legal requirements; to provide relative to general legal
3 requirements as a result of preventive health measures being undertaken to limit the
4 spread of COVID-19; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:10.5 is hereby enacted to read as follows: 
7 ยง10.5.  Suspension of legal deadlines; emergency
8	A.  In response to the threat posed by COVID-19, the governor of
9 Louisiana on March 11, 2020, declared a public health emergency in
10 Proclamation 25 JBE 2020.  The provisions of this Section are intended to be
11 part of the legislative response to this public health emergency and,
12 notwithstanding any provision of law to the contrary, shall supersede and
13 control to the extent of conflict with any other provision of law.
14	B.  During the public health emergency declared in Proclamation 25 JBE
15 2020, and any extension thereof, all deadlines in legal proceedings, including
16 liberative prescriptive and peremptive periods in all courts, administrative
17 agencies, and boards until the gubernatorial proclamation of the public health

1 emergency expires.
2 Section 2.  This Act shall become effective upon signature by the governor or, if not
3 signed by the governor, upon expiration of the time for bills to become law without signature
4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
5 vetoed by the governor and subsequently approved by the legislature, this Act shall become
6 effective on the day following such approval.

the gubernatorial proclamation of the public health emergency expires.
Effective upon signature of the governor or lapse of time for gubernatorial action.
