2020 Regular Session ENROLLED SENATE BILL NO. 84 BY SENATOR FIELDS 1 AN ACT 2 To amend and reenact R.S. 17:3805(B), relative to the Education Excellence Fund; to 3 specify a date for the state Department of Education to submit school and school 4 system fund expenditure plans for legislative approval; and to provide for related 5 matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 17:3805(B) is hereby amended and reenacted to read as follows: 8 ยง3805. Education Excellence Fund; prioritized plan for expenditure; legislative 9 approval; fund amounts and investment earnings credited to 10 ineligible entities 11 * * * 12 B.(1) The appropriate standing committees of the legislature shall be After 13 approving the expenditure plans submitted by schools and school systems, the 14 department shall submit the plans to the Senate Committee on Education and the 15 House Committee on Education for approval by November fifteenth of each year. 16 Approval by both committees shall be required. 17 (2) Upon receipt of those plans which have been approved by the state 18 Department of Education, the standing committees shall meet, either separately or 19 jointly, to consider and act on the plans. SB NO. 84 ENROLLED 1 (3) Approval shall be by motion which may be offered for all plans 2 considered at any meeting in globo or may, at the discretion of the chairperson 3 conducting the meeting, be acted on separately. Approval by either committee, 4 meeting separately, shall require a favorable vote on the motion by a majority of the 5 members present and voting, a quorum of the committee being present. Approval by 6 the two committees, meeting jointly, shall require a favorable vote on the motion by 7 a majority of the members thereof from each house present and voting, each house 8 voting separately, a quorum of the joint committee being present. 9 * * * 10 Section 2. This Act shall become effective upon signature by the governor or, if not 11 signed by the governor, upon expiration of the time for bills to become law without signature 12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 13 vetoed by the governor and subsequently approved by the legislature, this Act shall become 14 effective on the day following such approval.
