SENATE BILL NO. 92

SCHOOLS.  Provides relative to enrollment preferences at certain charter schools returned
to the transferring school system from the RSD. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 17:10.7.1(E)(6), relative to the return of certain charter schools
3 from the Recovery School District to the transferring school system; to provide for
4 certain enrollment preferences; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 17:10.7.1(E)(6) is hereby amended and reenacted to read as follows:
7 ยง10.7.1. Return of certain schools from the Recovery School District to the
8	transferring school system; time line; conditions; funding

10	E. Notwithstanding any law to the contrary, in order to support and protect
11 the interests and rights of the children it serves, the local school board:

13	(6) May provide a lottery preference for enrollment at elementary and middle
14 schools under the board's jurisdiction for students residing within defined geographic
15 zones as one of the factors to determine student assignment, according to policies
16 adopted by the board. Such preference shall be applied to not more than one-half
17 seventy-five percent of the seats available in each grade level to ensure that seats

1 in all schools are accessible to students residing outside of a school's geographic
2 zone. Notwithstanding the provisions of this Subsection, any Type 1 or Type 3
3 charter school that was first authorized by the board on, or prior to, July 1, 2016, and
4 whose charter contract includes a geographic preference in accordance with R.S.
5 17:3991 may maintain such preference with the approval of the board, in accordance
6 with board policy adopted for this purpose.

8 Section 2.  This Act shall become effective upon signature by the governor or, if not
9 signed by the governor, upon expiration of the time for bills to become law without signature
10 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
11 vetoed by the governor and subsequently approved by the legislature, this Act shall become
12 effective on the day following such approval.

Present law provides for the return of certain charter schools from the Recovery School
District (RSD) to the transferring local school system.
Present law allows a lottery preference for enrollment at elementary and middle schools for
students residing within defined geographic zones as a factor to determine student
assignment, according to policies adopted by the board.
Present law further provides such preference shall be applied to not more than one-half of
the seats available in each grade level and that a charter school authorized on or prior to
July 1, 2016, may maintain any existing geographic preferences.
Proposed law increases the lottery preference for students residing within the defined
geographic zones to not more than seventy-five percent of the seats available in each grade
level.
Effective upon signature of the governor or lapse of time for gubernatorial action.
