SENATE BILL NO. 95

LEVEES.  Provides for the board of commissioners of the St. Mary Levee District.  (8/1/20)
1	AN ACT
2 To amend and reenact R.S. 38:291(Z)(2), relative to the St. Mary Levee District; to provide
3 for the selection and appointment of the members of the board of commissioners;
4 and to provide for related matters.
5	Notice of intention to introduce this Act has been published.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 38:291(Z)(2) is hereby amended and reenacted to read as follows:
8 ยง291. Naming; limits of districts; composition of boards

12	(2) The district shall be governed by a board of commissioners consisting
13 of nine persons.  The commissioners shall be appointed as follows:
14	(a) The governor shall appoint, subject to Senate confirmation, board of
15 commissioners consisting of nine eight persons to the board of commissioners,
16 who reside in St. Mary Parish, and who meet the requirements of R.S. 38:304(A), as
17 follows:

12 Section 2. The term of the at-large member of the board of commissioners of the St.
13 Mary Levee District serving on August 1, 2020, shall terminate on September 1, 2020.
14 Section 3. On or before September 1, 2020, the legislative delegation shall appoint
15 the at-large commissioner to fill the unexpired term of the at-large member of the board of
16 commissioners who was serving on August 1, 2020. Thereafter, the at-large member of the
17 board appointed pursuant to this Act shall be appointed as provided in R.S. 38:291(Z)(4)(b).

Present law provides for a nine person board of commissioners for the St. Mary Levee
District appointed by the governor, subject to Senate confirmation, who reside in St. Mary
Parish and meet the requirements of R.S. 38:304(A).
Present law provides for the governor to appoint eight persons from a list submitted by the
St. Mary Parish Council containing three nominations from each of the eight single member
parish council districts in St. Mary Parish, from which the governor appoints one member
to represent each district.
Present law provides for the governor to appoint one member at-large from a list submitted
jointly by the legislative delegation representing St. Mary Parish.
Proposed law changes present law to provide for the legislative delegation to appoint one
person at-large to the board of commissioners of the St. Mary Levee District, subject to
Senate confirmation.
