SENATE CONCURRENT RESOL UTION NO. 30
BY SENATOR FRED MILLS 
MOTOR VEHICLES.  Requests a study to determine if individuals who modify motor
vehicles from standard vehicle specifications should be required to obtain certification in
defensive driving.
1	A CONCURRENT RESOL UTION
2 To urge and request the Department of Public Safety and Corrections, public safety services,
3 and office of motor vehicles, to conduct a study to determine if individuals who
4 modify motor vehicles from standard vehicle specifications should be required to
5 take a defensive driving course and to certify completion of the course to maintain
6 a Louisiana driver's license.
7 WHEREAS, a fatal automobile crash occurred on Louisiana Hwy. 31 in St. Martin
8 Parish at its intersection with Live Oak Circle on August 27, 2019, and tragically took the
9 young life of Phillip "Poppa" Dauterive, III, a 4th grade student at Episcopal School of
10 Acadiana; and
11 WHEREAS, Phillip was a passenger in the back seat of a 2005 Honda Accord driven
12 by his father, who was taking Phillip to Jujitsu practice; and
13 WHEREAS, the Accord was headed north on Louisiana Hwy. 31 and was struck
14 head-on by the driver of a "jacked-up" monster truck, a modified Ford F-250 truck, headed
15 south on Louisiana Hwy. 31, that swerved into the left lane attempting to avoid hitting a
16 vehicle that was stopped in the southbound lane waiting to make a left hand turn when the
17 F-250 truck hit the Accord head-on; and
18 WHEREAS, the "jacked-up" monster truck impaired the driver's line of site; and

1 WHEREAS, the operation of motor vehicles modified outside of standard safety
2 specifications contributes to the causes of automobile crashes; and
3 WHEREAS, a study of the operational safety of modified motor vehicles is needed
4 to determine if drivers of modified motor vehicles should be educated on their safe operation
5 in the interest of public safety.
6 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
7 urge and request the Department of Public Safety and Corrections, public safety services,
8 and office of motor vehicles, to conduct a study to determine if individuals who modify
9 motor vehicles from standard vehicle specifications should be required to take a defensive
10 driving course and to certify completion of the course to maintain a Louisiana driver's
11 license, and to report its findings and recommendations to the Senate Committee on
12 Transportation, Highways, and Public Works and the House Committee on Transportation,
13 Highways, and Public Works not later than February 1, 2021.
14 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
15 deputy secretary of the Department of Public Safety and Corrections, public safety services,
16 and office of motor vehicles.
