SENATE CONCURRENT RESOL UTION NO. 64

TAX/TAXATION.  Suspends franchise fees and compensation on promotional play wagers.
1	A CONCURRENT RESOL UTION
2 To suspend until sixty days after final adjournment of the 2021 Regular Session of the
3 Legislature of Louisiana the provisions of R.S. 27:91 with respect to the
4 compensation attributable to promotional play wagers and R.S. 27:241.1 with respect
5 to all franchise fees levied on promotional play wagers pursuant to R.S. 27:241.1.
6 WHEREAS, On March 11, 2020, Governor John Bel Edwards issued Emergency
7 Proclamation Number 25 JBE 2020 that declared a statewide public health emergency as a
8 result of the imminent threat posed to Louisiana citizens by the outbreak of a respiratory
9 disease caused by a novel coronavirus known commonly as COVID-19; and
10 WHEREAS, on March 13, 2020, Governor John Bel Edwards issued Emergency
11 Proclamation Number 27 JBE 2020 that supplemented the measures taken in his declaration
12 of a public health emergency with additional restrictions in order to further protect the health
13 and safety of the public because of COVID-19; and
14 WHEREAS, on March 22, 2020, Governor John Bel Edwards issued Emergency
15 Proclamation Number 33 JBE 2020 which implemented additional measures, including a
16 general stay-at-home order to the public and the temporary closure of certain businesses, and
17 further limiting the operations of certain nonessential businesses including casinos to the
18 public to mitigate the impact of COVID-19, and to disrupt the spread of the virus; and

1 WHEREAS, as a result of the issuance of the general stay-at-home order, the
2 temporary closure of certain businesses, and the further limiting of the operations of certain
3 nonessential businesses, the public, as well as employees, have suffered great economic
4 losses; and
5 WHEREAS, beginning May 16, 2020, the state's casinos will be able to reopen, but
6 only at twenty-five percent capacity; and 
7 WHEREAS, in an effort to mitigate some of the financial losses suffered by the
8 state's land-based and river boat casinos, the state should consider temporarily suspending
9 the franchise fees and compensation attributable to promotional play wagers. 
10 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby suspends
11 the provisions of R.S. 27:91 with respect to compensation for gross revenue over sixty
12 million dollars for promotional play wagers and R.S. 27:241.1 with respect to all franchise
13 fees for promotional play wagers.
14 BE IT FURTHER RESOLVED that for purposes of this suspension resolution,
15 "promotional play wagers" includes those wagers placed by patrons using noncashable
16 vouchers, promotional chips, coupons, electronic credits, electronic promotions, scrips, or
17 any other cash equivalent that is provided to the patron by the licensee.
18 BE IT FURTHER RESOLVED that this suspension shall become effective upon
19 adoption of this Resolution and shall extend through the sixtieth day after final adjournment
20 of the 2021 Regular Session of the Legislature of Louisiana.
