2020 Regular Session ENROLLED SENATE RESOLUTION NO. 48 BY SENATORS FRED MILLS, BARROW, BOUDREAUX, HENSGENS, LUNEAU, MCMATH, MIZELL, POPE AND WARD A RESOLUTION To direct the executive branch agencies under the jurisdictional oversight of the Senate Committee on Health and Welfare to continue to submit statutorily mandated reports until such time as the mandate is specifically amended or repealed. WHEREAS, R.S. 49:1401(A) provides that a legislative mandate to produce any report required of an executive branch agency first occurring on or after July 1, 2018, shall expire on the July first following the fifth regular session after the mandate was approved by the legislature; and WHEREAS, R.S. 49:1401(B) provides that a legislative mandate to produce any report required of an executive branch agency first occurring on or before June 30, 2018, shall expire on the July first following June 30, 2019, in the earliest year that is a multiple of five years after the mandate was initially approved by the legislature; and WHEREAS, R.S. 49:1401(C) provides that the standing committees having jurisdiction over the agency tasked with producing the report may extend the mandate for an additional five years by an affirmative vote of the majority of each committee at any time before July first on which the mandate is set to expire; and WHEREAS, the Senate Committee on Health and Welfare hereby gives notice to the Louisiana Department of Health, Department of Children and Family Services, Department of Veteran's Affairs, and every agency or commission statutorily created within each of those departments that, by the member's authorship of and affirmative votes to adopt this Resolution; the provisions of R.S. 49:1401(C) governing the extension of all mandates have been satisfied prior to July 1, extending the mandates for a continued five years of mandatory reporting; and Page 1 of 2 SR NO. 48 ENROLLED WHEREAS, it is further the direction and will of the committee that the Louisiana Department of Health, Department of Children and Family Services, Department of Veteran's Affairs, and every agency or commission statutorily created within each of those departments shall continue to submit all statutorily mandated reports until such time as the mandate is specifically amended or repealed. THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana does hereby direct the executive branch agencies under jurisdictional oversight of the Senate Committee on Health and Welfare to continue to submit statutorily mandated reports until such time as the mandate is specifically amended or repealed. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the secretary of the Louisiana Department of Health, the secretary of the Department of Children and Family Services, and the secretary of the Department of Veteran's Affairs.
