HOUSE BILL NO. 121
BY REPRESENTATIVE SEABAUGH AND SENATOR MI LLIGAN
POLICE/LOCAL:  Provides relative to employees of the Shreveport police department
1	AN ACT
2To amend and reenact R.S. 33:2213(K) and to repeal R.S. 33:2213(J), relative to the city of
3 Shreveport; to provide relative to the city's police department; to provide relative to
4 work shift cycles for certain employees of the department; and to provide for related
5 matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 33:2213(K) is hereby amended and reenacted to read as follows:
11 ยง2213.  Maximum hours; overtime or compensatory time; exceptions for certain
12	cities

14	K.  Notwithstanding any other provision of law to the contrary, including
15 Subsection A of this Section, the city cities of Houma and Shreveport may establish
16 and implement twelve-hour work shift cycles for all paid patrolmen, patrolmen first
17 class, sergeants, lieutenants, captains, dispatchers, or any other employees of the
18 police department except those in a position, grade, or class above that of captain. 
19 Such officers and employees shall be paid overtime at the rate of one and one-half
20 times their usual salary when the number of hours worked during the two-week work

1 cycle exceeds eighty hours or shall be credited with compensatory time on a one and
2 one-half basis for all hours in said cycle that exceed eighty hours.

4 Section 2.  R.S. 33:2213(J) is hereby repealed in its entirety.

Abstract: Authorizes the Shreveport police department to establish 12-hour shift cycles.
Present law provides that the maximum hours of work required of any full-time paid
patrolman, patrolman first class, sergeant, lieutenant, or captain, or any other employee of
a municipal police department, except those employed in a position, grade or class above
that of captain, is 40 hours per week except in cases of emergency.  Requires that for each
overtime hour, the employee be paid one and one-half times his usual salary.
Present law provides various exceptions for specific municipalities.
Present law provides that the present law does not apply to any employee of the city of
Shreveport police department in a position, grade, or class above lieutenant.  Proposed law
repeals present law.
Proposed law provides an additional exception applicable to Shreveport.  Authorizes the
Shreveport police department to establish 12-hour work shift cycles for all employees except
those in a position, grade, or class above that of captain.  Requires that such employees be
paid overtime at the rate of one and one-half times their usual salary or be credited with
compensatory time on a one and one-half basis for all hours worked in shift cycle above 80.
