HOUSE BILL NO. 180

UNEMPLOYMENT COMP:  Provides relative to unemployment compensation
requirements
1	AN ACT
2To enact R.S. 23:1600(3)(b)(iv), relative to unemployment compensation benefits; to
3 provide for benefit eligibility conditions; to provide for the active search
4 requirement; to require verification of attendance at employment interviews; to
5 provide for interview verification forms; to provide for the promulgation of rules; 
6 and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 23:1600(3)(b)(iv) is hereby enacted to read as follows:
9 ยง1600. Benefit eligibility conditions
10	An unemployed individual shall be eligible to receive benefits only if the
11 administrator finds that:

17	(iv)(aa)  When a claimant is scheduled for an employment interview, the
18 claimant shall produce sufficient proof of having attended the interview. The
19 sufficient proof of attendance shall be evidenced by the submission of a completed

1 interview verification form as prescribed by the Louisiana Workforce Commission
2 and shall set forth all of the following:
3	(I) The claimant's first and last name.
4	(II)  The employer's or company's name, physical address, and telephone
5 number. 
6	(III)  The interviewer's name and telephone number, if different from the
7 employer's or company's.
8	(IV)  The position for which the claimant is being interviewed.
9	(V)  The interviewer's signature.
10	(bb)  The Louisiana Workforce Commission shall promulgate all rules as are
11 necessary to facilitate the implementation of use of the interview verification form,
12 including but not limited to all of the following:
13	(I) The creation of the interview verification form.
14	(II)  The manner and method in which the Louisiana Workforce Commission
15 will provide the interview verification form to employers.
16	(III)  The manner and method by which employers can submit the completed
17 interview verification form to the Louisiana Workforce Commission.

Abstract:  Provides relative to unemployment compensation benefits by adding an
additional condition in order to satisfy the active search requirement.
Present law provides that an unemployed individual shall be eligible to receive benefits only
if the administrator finds that he has made a claim for benefits and he has registered for work
and continues to report with the administrator. Present law further provides that the
individual must be able to work, available for work, and is conducting an active search for
work.
Present law provides that the claimant will have satisfied the requirements of making an
active search for work if he is pursuing a course of action to become reemployed by
maintaining a reemployment assistance plan and an unemployment booklet.

Proposed law provides that when a claimant is scheduled for a job interview, the claimant
shall produce sufficient proof of having attended the interview. Proposed law further
provides that sufficient proof of attendance is evidenced by the submission of a completed
interview verification form, which shall be prescribed by the Louisiana Workforce
Commission (LWC) and set forth the following:
(1)The claimant's first and last name.
(2)The employer's or company's name, physical address, and telephone number.
(3)The interviewer's name and telephone number, if different from the employer's or
company's.
(4)The position for which the claimant is being interviewed.
(5)The interviewer's signature.
Proposed law provides that LWC shall promulgate all rules as are necessary to facilitate the
process of the interview verification form, including but not limited to all of the following:
(1)The creation of the interview verification form.
(2)The manner and method in which LWC will provide the interview verification form
to employers.
(3)The manner and method by which employers can submit the completed interview
verification form to LWC.
