HOUSE BILL NO. 237

APPROPRIATIONS/JUDGMENT:  Appropriates funds for payment of the consent
judgment against the state in the suit entitled Jerry Lacaze v. City of Natchitoches,
et al.
1	AN ACT
2To appropriate monies out of the state general fund for Fiscal Year 2021-2022 to be used to
3 pay the consent judgment captioned "Jerry Lacaze versus City of Natchitoches, et
4 al." between the Department of Transportation and Development and Jerry Lacaze;
5 to provide for certain requirements and limitations; to provide for an effective date;
6 and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  The sum of ten thousand and no/100 ($10,000) dollars, is hereby payable
9out of the State General Fund (Direct) for Fiscal Year 2021-2022 for payment of the consent
10judgment captioned "Jerry Lacaze versus City of Natchitoches, et al.", signed on January 28,
112020, between the state of Louisiana, through the Department of Transportation and
12Development and Jerry Lacaze bearing Number C-89244 Div. "B", on the docket of the
13Tenth Judicial District Court, parish of Natchitoches, state of Louisiana.
14 Section 2.  The judgment may only be paid from this appropriation if it is final and
15shall be paid as to principal, interest, court costs, and expert witness fees as awarded in the
16judgment.  If the provisions of the judgment conflict with the provisions of this Act, the
17provisions of the judgment shall be controlling.  Any other provision of this Act not in
18conflict with the provisions of the judgment shall control.  Payment shall be made only after
19presentation to the state treasurer of documentation required by the state treasurer.  Further,

1the judgment shall be deemed to have been paid on the effective date of this Act, and interest
2shall cease to run as of that date.  
3 Section 3.  This Act shall become effective on July 1, 2021; if vetoed by the governor
4and subsequently approved by the legislature, this Act shall become effective on July 1,
52021, or on the day following such approval by the legislature, whichever is later.

of the consent judgment captioned "Jerry Lacaze versus City of Natchitoches, et al.", bearing
No. C-89244, Div. "B" on the docket of the 10th JDC, parish of Natchitoches.
Proposed law provides requirements for payment from the state treasury.  Provides
contingencies in case of conflict between judgment and proposed law.  Prohibits accrual of
interest on the judgment as of the effective date of proposed law.
Effective July 1, 2021.
