1 AN ACT
2 To amend and reenact R.S. 4:144(B)(2)(b) and to enact R.S. 4:217(E), relative to the
3 Louisiana State Racing Commission; to provide for purse supplements; to require
4 that one member of the commission be from the Louisiana quarter horse industry;
5 and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 4:144(B)(2)(b) is hereby amended and reenacted and R.S. 4:217(E)
8 is hereby enacted to read as follows:
9 §144. Louisiana State Racing Commission; creation; membership; tenure; powers
10 and duties; quorum; qualification of members; per diem; expenses and
11 disbursements; bond; prohibited interest

17 (b) Three members shall be owners of racehorses which participate in any
18 race meeting licensed by the commission. One of the three owner-members shall be
19 from the Louisiana quarter horse industry.

1 §217. Purse supplements; designation and distribution

3 E. Notwithstanding, and in lieu of, any other provision of law, the monies
4 designated for purses under the provisions of R.S. 4:216(E) from wagers placed at
5 offtrack wagering facilities on historical horse races shall be distributed as follows:
6 (1) Seventy percent of the monies shall be allocated and provided to the
7 licensed racing associations in the state which conduct live horse racing on the basis
8 of the proportion of the number of thoroughbred race days each association
9 conducted for the preceding year bears to the total number of thoroughbred race days
10 conducted statewide for the preceding year, and such funds shall be used solely to
11 supplement purses in accordance with a schedule or formula established by the purse
12 committee of the Louisiana Thoroughbred Breeders Association on Louisiana-bred
13 thoroughbred races.
14 (2) Thirty percent of the monies shall be allocated and provided to the
15 licensed racing associations in the state which conduct live quarter horse racing on
16 the basis of the proportion of the number of quarter horse race days each association
17 conducted for the preceding year bears to the total number of quarter horse race days
18 conducted statewide for the preceding year, and such funds shall be used solely to
19 supplement purses in accordance with a schedule or formula established by the purse
20 committee of the Louisiana Quarter Horse Breeders Association on Louisiana-bred
21 quarter horse races.
22 Section 2. The provisions of this Act enacting R.S. 4:217(E) shall supersede the
23 provisions of the Act which originated as Senate Bill No. 209 of the 2021 Regular Session
24 enacting R.S. 4:217(E).
25 Section 3. This Act shall become effective upon signature by the governor or, if not
26 signed by the governor, upon expiration of the time for bills to become law without signature
27 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If

1 vetoed by the governor and subsequently approved by the legislature, this Act shall become
2 effective on the day following such approval.
