HOUSE BILL NO. 366

PROPERTY/PUBLIC:  Authorizes the exchange of state property in Caddo, Sabine,
Richland, and Morehouse Parishes for property in Ouachita Parish
1	AN ACT
2To authorize and provide for the transfer of certain public property; to authorize the
3 exchange of certain public property in Caddo, Sabine, Richland, Morehouse, and
4 Ouachita Parishes; to provide for the property descriptions; to provide for reservation
5 of mineral rights; to provide terms and conditions; to provide an effective date; and
6 to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  The secretary of the Department of Wildlife and Fisheries and the
9commissioner of administration, notwithstanding any other provision of law to the contrary,
10are hereby authorized and empowered to convey, transfer, assign, lease, or deliver any
11interest, excluding mineral rights, the state may have to all or any portion of the following
12described parcel of property to Wesley W. McConnell and Elise R. McConnell for the
13property described in Section 2 of this Act:
14 The portion of W1/2 T18N R5E SEC 36 lying North of U.S. Hwy 80 and east
15 of Lafourche Canal located in Richland Parish measuring approximately 60
16 acres; and the portion of NE1/4 of T17N R5E SEC 1 lying North of U.S.
17 Hwy 80 located in Richland Parish measuring approximately 39 acres; and
18 the portion of T18N R5E SEC 25, that portion thereof lying East of
19 Lafourche Canal being located in Morehouse and Ouachita Parishes,
20 measuring approximately 53 acres; all totaling approximately 152 acres.
21 Section 2.  In exchange for the above described properties in Section 1, the secretary
22of the Department of Wildlife and Fisheries and the commissioner of administration,
23notwithstanding any other provision of law to the contrary, are hereby authorized and
24empowered to accept, in addition to any other consideration, delivery of title to all or any

1portion of the following described parcels of property from Wesley W. McConnell and Elise
2R. McConnell:
3 That certain tract or parcel of ground in T16N R4E SEC 2 located in
4 Ouachita Parish, totaling approximately 219 acres.
5 Section 3.  The secretary of the Department of Wildlife and Fisheries and the
6commissioner of administration, and Wesley W. McConnell and Elise R. McConnell are
7hereby authorized to enter into such agreements, covenants, conditions, and stipulations and
8to execute such documents as necessary to properly effectuate any conveyance, transfer,
9assignment, lease, or delivery of title, excluding mineral rights, to the property described in
10Sections 1 and 2 of this Act, and as more specifically described in any such agreements
11entered into and documents executed by and between the secretary of the Department of
12Wildlife and Fisheries and the commissioner of administration, and Wesley W. McConnell
13and Elise R. McConnell, in exchange of consideration proportionate to the appraised value
14of the property.
15 Section 4.  The commissioner of administration and the commissioner of the
16Department of Agriculture and Forestry, notwithstanding any provision of law to the
17contrary, are hereby authorized and empowered to convey, transfer, assign, lease, or deliver
18any interest, excluding mineral rights, the state may have to all or any portion of the
19following described property to the City of Shreveport: 
20 A certain tract of land, together with any buildings and improvements
21 thereon, in Caddo Parish described as follows:
22
23 Commencing at Southwest Corner Lot 10 J.S. Allen Subdivision in Section 10,
24 Township 17 North, Range 14 West, run N 335.9 feet, thence N 60° 24' E 260.8 feet,
25 thence S 27° 47' E 150 feet for place of beginning, thence S 62° 13' W 30 feet,
26 thence S 27° 47' E 150 feet, thence N 62° 13' E 60 feet, thence N 27° 47' W 150 feet,
27 thence S 62° 13' W 30 feet to place of beginning, containing 0.21 acres.
28 Section 5. The commissioner of administration and the commissioner of the
29Department of Agriculture and Forestry  are hereby authorized to enter into such agreements,
30covenants, conditions, and stipulations and to execute such documents as necessary to
31properly effectuate any conveyance, transfer, assignment, lease, or delivery of title,
32excluding mineral rights, to the property described in Section 4 of this Act, and as more
33specifically described in any such agreements entered into and documents executed by and
34between the commissioner of administration, the commissioner of the Department of

1Agriculture and Forestry, and the City of Shreveport, in exchange for consideration
2proportionate to the appraised value of the property, or as otherwise provided by law.
3 Section 6. The commissioner of administration and the commissioner of the
4Department of Agriculture and Forestry, notwithstanding any provision of law to the
5contrary, are hereby authorized and empowered to convey, transfer, assign, lease, or deliver
6any interest, excluding mineral rights, the state may have to all or any portion of the
7following described property to the Sabine Parish Fire Protection District No. 1, Wards No.
81 and 2: 
9 The following described property, together with any buildings and 
10 improvements thereon, in Sabine Parish, to wit: 
11
12 Beginning at the Northwest corner of the Southwest Quarter of the Southeast Quarter
13 (SW 1/4 of SE 1/4) of Section 12, Township 5 North, Range 12 West, thence running
14 North 280 feet, thence East 500 feet, thence South 435 feet, thence West 500 feet,
15 thence North 155 feet to point of beginning and containing five (5) acres, more or
16 less, situated in Sabine Parish, Louisiana.   
17 With a right of way described as:
18 The Southeast quarter of Section 12, Township 5 North, Route 12 West said right of
19 way to follow the road as now established on said property as nearly as possible.
20 Section 7. The commissioner of administration and the commissioner of the
21Department of Agriculture and Forestry  are hereby authorized to enter into such agreements,
22covenants, conditions, and stipulations and to execute such documents as necessary to
23properly effectuate any conveyance, transfer, assignment, lease, or delivery of title,
24excluding mineral rights, to the property described in Section 6 of this Act, and as more
25specifically described in any such agreements entered into and documents executed by and
26between the commissioner of administration, the commissioner of the Department of
27Agriculture and Forestry, and the Sabine Parish Fire Protection District No. 1, Wards No.
281 and 2, in exchange for consideration proportionate to the appraised value of the property,
29or as otherwise provided by law.
30 Section 8.  This Act shall become effective upon signature by the governor or, if not
31signed by the governor, upon expiration of the time for bills to become law without signature
32by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
33vetoed by the governor and subsequently approved by the legislature, this Act shall become
34effective on the day following such approval.

Authorizes the sale of certain properties owned by the Dept. of Agriculture and Forestry
located in Caddo and Sabine parishes to the city of Shreveport and to the Sabine Parish Fire
Protection District No. 1, Wards No. 1 and 2.
Provides for the reservation of mineral rights to the state.
Effective upon signature of governor or lapse of time for gubernatorial action.
Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Natural Resources and
Environment to the original bill:
1. Authorize the sale of certain properties owned by the Department of Agriculture
and Forestry located in Caddo and Sabine Parishes to the City of Shreveport and
to the Sabine Parish Fire Protection District No. 1, Wards No. 1 and 2.
2. Make a technical change.
