ENROLLED ACT No. 229 2021 Regular Session HOUSE BILL NO. 366 BY REPRESENTATIVE MCFARLAND 1 AN ACT 2 To authorize and provide for the transfer of certain public property; to authorize the 3 exchange of certain public property in Caddo, Sabine, Richland, Morehouse, and 4 Ouachita Parishes; to provide for the property descriptions; to provide for reservation 5 of mineral rights; to provide terms and conditions; to provide an effective date; and 6 to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. The secretary of the Department of Wildlife and Fisheries and the 9 commissioner of administration, notwithstanding any other provision of law to the contrary, 10 are hereby authorized and empowered to convey, transfer, assign, lease, or deliver any 11 interest, excluding mineral rights, the state may have to all or any portion of the following 12 described parcel of property to Wesley W. McConnell and Elise R. McConnell for the 13 property described in Section 2 of this Act: 14 The portion of W1/2 T18N R5E SEC 36 lying North of U.S. Hwy 80 and east 15 of Lafourche Canal located in Richland Parish measuring approximately 60 16 acres; and the portion of NE1/4 of T17N R5E SEC 1 lying North of U.S. 17 Hwy 80 located in Richland Parish measuring approximately 39 acres; and 18 the portion of T18N R5E SEC 25, that portion thereof lying East of 19 Lafourche Canal being located in Morehouse and Ouachita Parishes, 20 measuring approximately 53 acres; all totaling approximately 152 acres. 21 Section 2. In exchange for the above described properties in Section 1, the secretary 22 of the Department of Wildlife and Fisheries and the commissioner of administration, 23 notwithstanding any other provision of law to the contrary, are hereby authorized and 24 empowered to accept, in addition to any other consideration, delivery of title to all or any Page 1 of 4 HB NO. 366 ENROLLED 1 portion of the following described parcels of property from Wesley W. McConnell and Elise 2 R. McConnell: 3 That certain tract or parcel of ground in T16N R4E SEC 2 located in 4 Ouachita Parish, totaling approximately 219 acres. 5 Section 3. The secretary of the Department of Wildlife and Fisheries and the 6 commissioner of administration, and Wesley W. McConnell and Elise R. McConnell are 7 hereby authorized to enter into such agreements, covenants, conditions, and stipulations and 8 to execute such documents as necessary to properly effectuate any conveyance, transfer, 9 assignment, lease, or delivery of title, excluding mineral rights, to the property described in 10 Sections 1 and 2 of this Act, and as more specifically described in any such agreements 11 entered into and documents executed by and between the secretary of the Department of 12 Wildlife and Fisheries and the commissioner of administration, and Wesley W. McConnell 13 and Elise R. McConnell, in exchange of consideration proportionate to the appraised value 14 of the property. 15 Section 4. The commissioner of administration and the commissioner of the 16 Department of Agriculture and Forestry, notwithstanding any provision of law to the 17 contrary, are hereby authorized and empowered to convey, transfer, assign, lease, or deliver 18 any interest, excluding mineral rights, the state may have to all or any portion of the 19 following described property to the City of Shreveport: 20 A certain tract of land, together with any buildings and improvements 21 thereon, in Caddo Parish described as follows: 22 Commencing at Southwest Corner Lot 10 J.S. Allen Subdivision in Section 23 10, Township 17 North, Range 14 West, run N 335.9 feet, thence N 60° 24' 24 E 260.8 feet, thence S 27° 47' E 150 feet for place of beginning, thence S 62° 25 13' W 30 feet, thence S 27° 47' E 150 feet, thence N 62° 13' E 60 feet, thence 26 N 27° 47' W 150 feet, thence S 62° 13' W 30 feet to place of beginning, 27 containing 0.21 acres. 28 Section 5. The commissioner of administration and the commissioner of the 29 Department of Agriculture and Forestry are hereby authorized to enter into such agreements, 30 covenants, conditions, and stipulations and to execute such documents as necessary to 31 properly effectuate any conveyance, transfer, assignment, lease, or delivery of title, 32 excluding mineral rights, to the property described in Section 4 of this Act, and as more Page 2 of 4 HB NO. 366 ENROLLED 1 specifically described in any such agreements entered into and documents executed by and 2 between the commissioner of administration, the commissioner of the Department of 3 Agriculture and Forestry, and the City of Shreveport, in exchange for consideration 4 proportionate to the appraised value of the property, or as otherwise provided by law. 5 Section 6. The commissioner of administration and the commissioner of the 6 Department of Agriculture and Forestry, notwithstanding any provision of law to the 7 contrary, are hereby authorized and empowered to convey, transfer, assign, lease, or deliver 8 any interest, excluding mineral rights, the state may have to all or any portion of the 9 following described property to the Sabine Parish Fire Protection District No. 1, Wards No. 10 1 and 2: 11 The following described property, together with any buildings and 12 improvements thereon, in Sabine Parish, to wit: 13 Beginning at the Northwest corner of the Southwest Quarter of the Southeast 14 Quarter (SW 1/4 of SE 1/4) of Section 12, Township 5 North, Range 12 15 West, thence running North 280 feet, thence East 500 feet, thence South 435 16 feet, thence West 500 feet, thence North 155 feet to point of beginning and 17 containing five (5) acres, more or less, situated in Sabine Parish, Louisiana. 18 With a right of way described as: 19 The Southeast quarter of Section 12, Township 5 North, Route 12 West said 20 right of way to follow the road as now established on said property as nearly 21 as possible. 22 Section 7. The commissioner of administration and the commissioner of the 23 Department of Agriculture and Forestry are hereby authorized to enter into such agreements, 24 covenants, conditions, and stipulations and to execute such documents as necessary to 25 properly effectuate any conveyance, transfer, assignment, lease, or delivery of title, 26 excluding mineral rights, to the property described in Section 6 of this Act, and as more 27 specifically described in any such agreements entered into and documents executed by and 28 between the commissioner of administration, the commissioner of the Department of 29 Agriculture and Forestry, and the Sabine Parish Fire Protection District No. 1, Wards No. 30 1 and 2, in exchange for consideration proportionate to the appraised value of the property, 31 or as otherwise provided by law. This Act shall become effective upon signature by the governor or, if not 2 signed by the governor, upon expiration of the time for bills to become law without signature 3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 4 vetoed by the governor and subsequently approved by the legislature, this Act shall become 5 effective on the day following such approval.
