MEDICAID:  Provides relative to extension of medicaid coverage for an individual
experiencing postpartum
1	AN ACT
2To enact R.S. 46:447.4, relative to the medical assistance program of this state known as
3 Medicaid; to provide for Medicaid eligibility for low-income pregnant individuals;
4 to provide for postpartum coverage; to provide for approval by the Centers for
5 Medicare and Medicaid Services; to require administrative rulemaking; and to
6 provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 46:447.4 is hereby enacted to read as follows: 
9 ยง447.4. Postpartum care; Medicaid eligibility
10	A.  Subject to approval by the Centers for Medicare and Medicaid Services
11 and to the provisions of Subsection B of this Section, on and after April 1, 2022, the
12 Louisiana Department of Health shall provide postpartum Medicaid coverage for
13 twelve months after the pregnancy ends for eligible pregnant individuals who qualify
14 under the state's Medicaid plan.
15	B.  The Louisiana Department of Health shall not implement the provisions
16 of this Section until sufficient funds are appropriated by the Legislature of Louisiana.

1	C.  The Louisiana Department of Health shall promulgate all such rules in
2 accordance with the Administrative Procedure Act as are necessary to implement the
3 provisions of this Section.

Abstract:  Provides relative to the extension of Medicaid coverage for individuals
experiencing postpartum.
Proposed law provides that subject to approval by the Centers for Medicare and Medicaid
Services (CMS), on and after Apr. 1, 2022, the Louisiana Department of Health (LDH) shall
provide postpartum Medicaid coverage to eligible pregnant individuals who qualify under
the state's Medicaid plan, 12 months after the end of their pregnancy.
Proposed law prohibits LDH from furnishing such coverage until the legislature appropriates
the necessary funding.
Proposed law provides that LDH shall promulgate all such rules in accordance with present
law as are necessary to implement the provisions of proposed law.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Health and Welfare to
the original bill:
1. Provide that postpartum Medicaid coverage to eligible pregnant individuals who
satisfy the state's Medicaid qualifications is subject to approval by the Centers
for Medicare and Medicaid Services, on or after April 1, 2022.  
2. Provide that the Louisiana Department of Health shall not furnish any coverage
absent the requisite funding from the state legislature.  
3. Make technical changes.  
The House Floor Amendments to the engrossed bill:
1. Changes funding provision to state that the Louisiana Department of Health shall
not implement the provisions of proposed law absent sufficient funding from the
state legislature.
