HLS 21RS-3954 ORIGINAL 2021 Regular Session HOUSE CONCURRENT RESOL UTION NO. 130 BY REPRESENTATIVE DAVIS PILOTS: Creates a joint subcommittee to review and make recommendations relative to all aspects of the state pilot program on the Mississippi River 1 A CONCURRENT RESOL UTION 2To authorize and direct the House Committee on Commerce, or a subcommittee thereof, and 3 Senate Committee on Commerce, Consumer Protection, and International Affairs, 4 or a subcommittee thereof, to meet and function as a joint subcommittee to study, 5 review, monitor, and make recommendations relative to all aspects of the state pilot 6 program on the Mississippi River and to report the findings of the joint 7 subcommittee to the legislature prior to the convening of the 2022 Regular Session 8 of the Legislature of Louisiana. 9 WHEREAS, the Mississippi River is at the nexus of various national and 10international transportation systems, including marine transportation systems, and serves as 11the intermodal gateway to the nation's interior; and 12 WHEREAS, the technical, policy, operational, and educational demands of ocean, 13river, canal, and channel transportation and the integration of these systems is critical to our 14nation's commerce. 15 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 16authorize and direct the House Committee on Commerce, or a subcommittee thereof, and 17Senate Committee on Commerce, Consumer Protection, and International Affairs, or a 18subcommittee thereof, to meet and function as a joint subcommittee. 19 BE IT FURTHER RESOLVED that the Legislature of Louisiana directs the joint 20subcommittee to study, review, monitor, and make recommendations relative to all aspects 21of the state pilot program on the Mississippi River and to report the findings of the joint Page 1 of 4 HLS 21RS-3954 ORIGINAL HCR NO. 130 1subcommittee to the legislature prior to the convening of the 2022 Regular Session of the 2Legislature of Louisiana. 3 BE IT FURTHER RESOLVED that the Legislature of Louisiana further directs the 4joint subcommittee be constituted in accordance with all of the following: 5 (1)Seven members of the House of Representatives appointed by the speaker of 6 the House of Representatives in a manner to reflect the makeup of the 7 membership of the House of Representatives, including party affiliation, 8 race, sex, and geography, to the extent practicable. Five of the members 9 appointed by the speaker shall be members of the House Committee on 10 Commerce, and two members appointed by the speaker shall be at-large 11 appointments. 12 (2)Seven members of the Senate appointed by the president of the Senate in a 13 manner to reflect the makeup of the membership of the Senate, including 14 party affiliation, race, sex, and geography, to the extent practicable. Four of 15 the members appointed by the president shall be members of the Senate 16 Committee on Commerce, Consumer Protection, and International Affairs, 17 and three of the members appointed by the president shall be at-large 18 appointments. 19 (3)The joint subcommittee shall select a chair and a vice chair from among its 20 members. 21 (4)The staff of the House Committee on Commerce, the Senate Committee on 22 Commerce, Consumer Protection, and International Affairs, the legislative 23 fiscal office, and the legislative auditor shall provide staff support to the joint 24 subcommittee. 25 (5)The joint subcommittee may call upon the staffs of any department, agency, 26 or official of the state, or its successor, for data and assistance, and all 27 departments, agencies, and officials shall cooperate with the joint 28 subcommittee. 29 (6)The joint subcommittee shall have the power and authority of a standing 30 committee of either chamber. Page 2 of 4 HLS 21RS-3954 ORIGINAL HCR NO. 130 1 (7)For the purposes of this Resolution, the term "state pilot program" shall mean 2 and include all programs, provisions, activities, and functions pertaining to 3 pilots and pilotage on the Mississippi River as provided in or pursuant to 4 Title 34 of the Louisiana Revised Statutes of 1950. 5 BE IT FURTHER RESOLVED that the Legislature of Louisiana further directs the 6joint subcommittee to do all of the following: 7 (1)Review how the state pilot program on the Mississippi River relates to the 8 public and private provision of pilotage in this state and the other states. 9 (2)Recommend policies and strategies to encourage all of the following on the 10 Mississippi River: 11 (a)Workforce diversity, equity, inclusion, development, compliance, and 12 education. 13 (b)Safe pilotage. 14 (c)Fair rates and dealings. 15 (3)Review federal, state, and local laws as it relates to associations, oversight, 16 duty, responsibilities, and business relative to the state pilot program on the 17 Mississippi River. 18 (4)Recommend, to the extent the joint subcommittee deems appropriate, 19 improvements in laws, rules, and regulations concerning the state pilot 20 program on the Mississippi River. 21 (5)Develop a plan of action for the future of the state pilot program on the 22 Mississippi River. 23 (6)Review equity, diversity, and inclusion of state pilot programs on the 24 Mississippi River. 25 BE IT FURTHER RESOLVED that the speaker of the House of Representatives of 26and the president of the Senate shall appoint the members of the joint subcommittee no later 27than thirty days after adoption of this Concurrent Resolution. 28 BE IT FURTHER RESOLVED that a member of the joint subcommittee designated 29by the speaker of the House of Representatives shall call the first meeting of the joint Page 3 of 4 HLS 21RS-3954 ORIGINAL HCR NO. 130 1subcommittee no later than ten days after all of the members are appointed and shall preside 2until the joint subcommittee selects a chair and a vice chair. 3 BE IT FURTHER RESOLVED that the joint subcommittee shall report its findings 4and recommendations to the Legislature of Louisiana including any proposed legislation 5prior to the convening of the 2022 Regular Session but no later than February 1, 2022.
