2021 Regular Session ENROLLED SENATE CONCURRENT RESOL UTION NO. 25 BY SENATOR CATHEY A CONCURRENT RESOL UTION To urge and request the commissioner of administration to provide the legislature with a list of all nonstate entity capital outlay projects which have not been required to provide matching funds. WHEREAS, R.S. 39:112(E) provides that nonstate entity capital outlay projects shall require a match of not less than twenty-five percent of the total requested amount of funding except in three instances; and WHEREAS, matching funds are not required for a nonstate entity project which is: (a) a project deemed by the commissioner of administration to be an emergency project; (b) a project of a nonstate entity which has demonstrated its inability to provide a local match where the division of administration has promulgated rules establishing a needs-based formula for determining the inability of a nonstate entity to provide the required local match, however such rules have never been promulgated; (c) a project for a rural water system servicing less than one thousand two hundred fifty customers; and WHEREAS, there is no site where the nonstate entities or the public can see which nonstate entity projects have had the match requirement waived either because the commissioner deemed the project to be an emergency or the project is for a rural water system servicing less than one thousand two hundred fifty customers. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the commissioner of administration to submit to the legislature, no later than fourteen days after the effective date of this Senate Concurrent Resolution, a list of all of the nonstate entity capital outlay projects for which the matching funds requirement has been waived for nonstate projects in the 2016-2017 capital outlay act through and including the projects in the 2021-2022 capital outlay bill.
