HOUSE BILL NO. 1029

MUSEUMS:  Provides relative to Shreveport Water Works Museum
1	AN ACT
2To enact Chapter 5-M of Title 25 of the Louisiana Revised Statutes of 1950, to be comprised
3 of R.S. 25:380.101 through 380.104, to create the Shreveport Water Works Museum
4 in the Department of Culture, Recreation and Tourism; to provide relative to the
5 establishment, location, purpose and use of the museum; to provide relative to
6 operating funds and appropriations by the legislature; to provide relative to donations
7 loans, and the disposition of property; to provide relative to the use of collections and
8 property of the museum; to provide relative to the authority of the lieutenant
9 governor and the Department of Culture, Recreation and Tourism with respect to the
10 museum; and to provide for related matters.
11Be it enacted by the Legislature of Louisiana:
12 Section 1.  Chapter 5-M of Title 25 of the Louisiana Revised Statutes of 1950, to be
13comprised of R.S. 25:380.101 through 380.104, is hereby enacted to read as follows:
14 CHAPTER 5-M.  SHREVEPORT WATER WORKS MUSEUM
15 §380.101.  Establishment and location; purpose and use
16	A.  The Shreveport Water Works Museum is established as a facility in the
17 city of Shreveport, parish of Caddo, under the overall jurisdiction of the Department
18 of Culture, Recreation and Tourism as more specifically provided in this Chapter.
19	B.  The Shreveport Water Works Museum shall be a historical, cultural,
20 scientific, and technological institution whose primary purpose shall be to research,

1 collect, preserve, and present, as an educational resource, the pictures and
2 photographs, documents, artifacts, objects of art, and the like that reflect the social,
3 cultural, and economic history of the pumping station and water supply related
4 artifacts of Louisiana.
5 §380.102.  Operating funds; appropriations by the legislature
6	A.  The Department of Culture, Recreation, and Tourism shall include in its
7 annual budget request, required by R.S. 39:32, a request for funds necessary for
8 support of the Shreveport Water Works Museum.  The governor shall include in the
9 executive budget submitted to the legislature sufficient funding for the support of
10 operations of the museum.
11	B.  Funds appropriated by the legislature to the Department of Culture,
12 Recreation, and Tourism for operation of the Shreveport Water Works Museum shall
13 be used solely for that purpose.  No administrative costs of any kind shall be charged
14 by the Department of Culture, Recreation, and Tourism for any services associated
15 with placement of the museum within the jurisdiction of the department.
16	C.(1)  If sufficient funds necessary for the operation of the Shreveport Water
17 Works Museum are not appropriated by the legislature, and funds from other local,
18 public, or private sources are not available for this purpose, the Department of
19 Culture, Recreation and Tourism is authorized to temporarily close the museum to
20 the public until such time as sufficient funds necessary for the operation of the
21 museum are appropriated by the legislature.  The Department of Culture, Recreation
22 and Tourism shall maintain the museum during any period of temporary closure.
23	(2)  The Department of Culture, Recreation and Tourism may accept and use,
24 in accordance with law, gifts, grants, bequests, donations endowments, or funds from
25 any public or private source to support the operations of the museum.
26 §380.103.  Donations and loans; disposition of property
27	A.  The Department of Culture, Recreation and Tourism may solicit and
28 accept funds, governmental grants, donations, and contributions of lands, buildings,
29 monies, artifacts, relics, video recordings, motion picture films, books and papers,

1 pictures and photographs, documents, works of art, or other property on behalf of
2 and as additions to the Shreveport Water Works Museum either in the form of loans
3 or in the form of donations inter vivos or mortis causa, and the Department of
4 Culture, Recreation and Tourism may acquire them by purchase, lease, or otherwise,
5 subject to the terms, conditions, or limitations contained in the instrument by which
6 such property is acquired.  However, the museum, through the Department of
7 Culture, Recreation and Tourism, may enter into any and all contracts with any
8 person, lender, or donor that it may deem fit, proper, and necessary to accept and
9 receive such lands, buildings, monies, artifacts, relics, video recordings, motion
10 picture films, books and papers, pictures and photographs, documents, works of art,
11 or other property on behalf of and as additions to the Shreveport Water Works
12 Museum.  The museum may serve as the beneficiary of any public trust heretofore
13 or hereafter created for such purpose pursuant to the provisions of R.S. 9:2341 et seq.
14	B.  The Board of Directors of the Louisiana State Museum is granted the
15 authority of deaccession with respect to any collection of the Shreveport Water
16 Works Museum and, for such purpose, is exempted from laws relative to the sale or
17 disposal of surplus property.  The Board of Directors of the Louisiana State Museum
18 shall establish policies and procedures necessary to carry out this authority in an
19 orderly manner.
20	C.  (1)  Any property which has been deposited with the Shreveport Water
21 Works Museum, by loan or otherwise, and which has been held by the museum for
22 more than ten years, and to which no person has made claim shall be deemed to be
23 abandoned and, notwithstanding the provisions of Chapter 1 of Title XII of Book III
24 of the Louisiana Civil Code, shall become the property of the museum, provided that
25 Paragraph (2) of this Subsection has been complied with.
26	(2)(a)  At least once each week for two consecutive weeks, the Board of
27 Directors of the Louisiana State Museum shall cause to be published in at least one
28 newspaper of general circulation in the parish of Caddo a notice and listing of the
29 property.

1	(b)  The notice shall contain:
2	(i)  The name and last known address, if any, of the last known owner or
3 depositor of the property.
4	(ii)  A description of the property.
5	(iii)   A statement that if proof of claim is not presented by the claimant to the
6 board and if the claimant's right to receive such property is not established to the
7 satisfaction of the board within sixty-five days from the date of the second published
8 notice, the property will be deemed to be abandoned and shall become the property
9 of the Shreveport Water Works Museum.
10	(3)  If no valid claim has been made to the property within sixty-five days
11 from the date of the second published notice, title to the property shall vest in the
12 Shreveport Water Works Museum free from all claims.
13 §380.104.  Use of collections
14	Any collection of the Shreveport Water Works Museum may, subject to
15 approval of the Board of Directors of the Louisiana State Museum, be lent in part. 
16 The Board of Directors of the Louisiana State Museum shall ensure proper
17 safeguards for its maintenance and return and shall ensure that proper records are
18 kept.  The collections shall be available for use in educational projects, subject to the
19 approval of the Board of Directors of the Louisiana State Museum.

Abstract:  Provides for the creation of the Shreveport Water Works Museum within the
Dept. of Culture, Recreation and Tourism.
Proposed law establishes the Shreveport Water Works Museum within the Dept. of Culture,
Recreation and Tourism.  
Requires that the Dept. of Culture, Recreation and Tourism's budget request and the
governor's executive budget include funds sufficient to support the museum.  Requires that
funds appropriated for operation of the museum be used for such purpose and in accordance
with the budget plan required by proposed law.  Prohibits charging the Dept. of State any
administrative costs associated with placing the museum within the department.

Authorizes the department and the board to solicit and accept funds and other property for
the museum either as loans or donations and provides with respect thereto.  Authorizes the
museum to serve as the beneficiary of any public trust created for such purpose.  Grants the
Board of Directors of the La. State Museum authority of deaccession with respect to any
collection of the museum and in case of such deaccessions exempts the board of directors
from present law relative to sale or disposal of surplus property.  Requires board policies and
procedures to carry out such authority.
Provides relative to unclaimed property loaned to or otherwise left with the museum. 
Provides that such property shall become property of the museum after 10 years and after
notice according to specified procedures.  Provides relative to loans of museum property. 
Provides that museum collections shall be available for use in educational projects subject
to board approval.
Effective upon signature of governor or lapse of time for gubernatorial action.
