ENROLLED ACT No. 19 2022 Regular Session HOUSE BILL NO. 15 BY REPRESENTATIVE BAGLEY 1 AN ACT 2 To enact R.S. 13:3049(B)(1)(e)(viii) and R.S. 15:255(X), relative to costs of court; to 3 authorize the transfer of surplus monies in the Forty-Second Judicial District; to 4 provide for the transfer procedures of funds; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 13:3049(B)(1)(e)(viii) is hereby enacted to read as follows: 7 §3049. Cash deposit; bond; duty to attend; compensation; procedure; filing fees 8 * * * 9 B.(1) 10 * * * 11 (e) 12 * * * 13 (viii) Notwithstanding any provision of law to the contrary, any surplus 14 monies in the special fund of DeSoto Parish within the Forty-Second Judicial District 15 may be transferred to the criminal court fund on an as needed basis upon the motion 16 of the district attorney and the order of judges sitting en banc. 17 * * * 18 Section 2. R.S. 15:255(X) is hereby enacted to read as follows: 19 §255. Witness fees to off-duty law enforcement officers 20 * * * 21 X. HB NO. 15 ENROLLED 1 shall be transmitted by the governing authority of the parish to the criminal court 2 fund of the Forty-Second Judicial District. As used in this Subsection, "special fund" 3 means the special fund provided for in Subsection D of this Section, and "surplus 4 monies" means the amount of money in the special fund in excess of fifty thousand 5 dollars at the end of the calendar year. The surplus monies which are transferred by 6 this Subsection may be used for any purpose for which the other monies in the 7 criminal court fund of the Forty-Second Judicial District Court may be used.
