HLS 22RS-123 ORIGINAL 2022 Regular Session HOUSE BILL NO. 177 BY REPRESENTATIVES EDMONSTON, AMEDEE, BAGLEY, BUTLER, ECHOLS, GADBERRY, HODGES, HORTON, MCCORMICK, CHARLES OWEN, SCHAMERHORN, SEAB AUGH, AND WRIGHT DISCRIMINATION: (Constitutional Amendment) Prohibits discrimination based on vaccination or immunity status 1 A JOINT RESOLUTION 2Proposing to amend Article I, Sections 3 and 12 of the Constitution of Louisiana, to prohibit 3 arbitrary, capricious, or unreasonable discrimination based on vaccination or 4 immunity status; to prohibit discrimination in access to public areas, 5 accommodations, and facilities based on vaccination or immunity status; to provide 6 for submission of the proposed amendment to the electors; and to provide for related 7 matters. 8 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members 9elected to each house concurring, that there shall be submitted to the electors of the state of 10Louisiana, for their approval or rejection in the manner provided by law, a proposal to 11amend Article I, Sections 3 and 12 of the Constitution of Louisiana, to read as follows: 12 §3. Right to Individual Dignity 13 Section 3. No person shall be denied the equal protection of the laws. No 14 law shall discriminate against a person because of race or religious ideas, beliefs, or 15 affiliations. No law shall arbitrarily, capriciously, or unreasonably discriminate 16 against a person because of birth, age, sex, culture, physical condition, or political 17 ideas or affiliations. Physical condition includes a person's vaccination status or 18 immunity status. In access to public areas, accommodations, and facilities, every 3 person shall be free from discrimination based on race, religion, or national ancestry 4 and from arbitrary, capricious, or unreasonable discrimination based on age, sex, or 5 physical condition. Physical condition includes a person's vaccination status or 6 immunity status. 7 Section 2. Be it further resolved that this proposed amendment shall be submitted 8to the electors of the state of Louisiana at the statewide election to be held on November 8, 92022. 10 Section 3. Be it further resolved that on the official ballot to be used at the election, 11there shall be printed a proposition, upon which the electors of the state shall be permitted 12to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as 13follows: 14 Do you support an amendment to prohibit arbitrary, capricious, or 15 unreasonable discrimination based on a person's vaccination status or 16 immunity status?
