HOUSE BILL NO. 343

SMALL BUSINESS:  Increases the gross annual sales threshold under which a home-based
preparer of low-risk foods may qualify for the protections of the statute known
commonly as the cottage food law
1	AN ACT
2To amend and reenact R.S. 40:4.9(B), relative to the cottage food law; to provide for gross
3 annual sales of low risk foods; to provide for qualifications for protection; and to
4 provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:4.9(B) is hereby amended and reenacted to read as follows: 
7 ยง4.9.  Low-risk foods; preparation in home for public consumption

9	B.  This Section shall not apply to any preparer of low-risk foods made at a
10 home for sale, whose gross annual sales equal twenty fifty thousand dollars or more.

Abstract:  Increases the gross annual sales threshold for home-based, low-risk food
preparers.
Present law provides that any preparer of low-risk foods whose gross annual sales are
$20,000 or more does not qualify for protection under present law exempting such persons
from certain regulations relative to the preparation of food for public consumption.
