WEIGHTS/MEASURES: Provides for the regulation of fueling stations for electric vehicles
1 AN ACT
2To amend and reenact R.S. 3:4602(4) and (29), relative to weighing and measuring devices;
3 to provide for definitions to include "electric vehicle supply equipment"; to provide
4 an effective date; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 3:4602(4) and (29) are hereby amended and reenacted to read as
7follows:
8 ยง4602. Definitions
9 As used in this Chapter, the following terms shall have the following
10 meanings:

12 (4) "Commercial weighing and measuring device" means any weight,
13 measure, or weighing or measuring device commercially used or employed in
14 establishing the size, quantity, extent, area, time, distance, or measurement of
15 quantities, things, produce, or articles for distribution or consumption, purchased,
16 offered, or submitted for sale, hire or award, or in computing any basic charge or
17 payment for services rendered on the basis of weight or measure. Except as
18 otherwise provided, the term shall include scales, weighing devices, and metering
19 and measuring devices commercially used for determining the weight or amount of
20 petroleum products, as well as electric vehicle supply equipment. It shall also

1 include any accessory attached to or used in connection with a commercial weighing
2 or measuring device when such accessory is so designed or installed that its
3 operation affects the accuracy of the device.

5 (29) "Weights, measures, and weighing and measuring devices" includes all
6 weights, scales, beams, measures of every kind, instruments and mechanical devices
7 for weighing or measuring, scanners or scanning devices that determine product
8 identity and price at the point of sale, electric vehicle supply equipment, and any
9 appliances and accessories connected with any such instruments. However, it does
10 not include or refer to devices used to meter or measure, other than by weight, water,
11 natural or manufactured gas, or electricity, except for electricity used in connection
12 with electric vehicle supply equipment.
13 Section 2. This Act shall become effective upon signature by the governor or, if not
14signed by the governor, upon expiration of the time for bills to become law without signature
15by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
16vetoed by the governor and subsequently approved by the legislature, this Act shall become
17effective on the day following such approval.

Abstract: Adds "electric vehicle supply equipment" to certain definitions under the La.
Weights and Measures Law.
Present law defines a "commercial weighing and measuring device" as any weight, measure,
or weighing or measuring device commercially used or employed in establishing the size,
quantity, extent, area, time, distance, or measurement of quantities, things, produce, or
articles for distribution or consumption, purchased, offered, or submitted for sale, hire or
award, or in computing any basic charge or payment for services rendered on the basis of
weight or measure. Except as otherwise provided, the term includes scales, weighing
devices, and metering and measuring devices commercially used for determining the weight
or amount of petroleum products. Specifies that it also includes any accessory attached to
or used in connection with a commercial weighing or measuring device when such accessory
is so designed or installed that its operation affects the accuracy of the device.

Proposed law maintains present law and adds "electric vehicle supply equipment" as what
is also included in the term "commercial weighing and measuring device".
Present law defines "weights, measures, and weighing and measuring devices" to include all
weights, scales, beams, measures of every kind, instruments and mechanical devices for
weighing or measuring, scanners or scanning devices that determine product identity and
price at the point of sale, and any appliances and accessories connected with any such
instruments. However, specifies that it does not include or refer to devices used to meter or
measure, other than by weight, water, natural or manufactured gas, or electricity.
Proposed law maintains present law and adds "electric vehicle supply equipment" as one of
the included devices.
Effective upon signature of the governor or lapse of time for gubernatorial action.
