HOUSE BILL NO. 446
BY REPRESENTATIVE DESHOTEL
1	AN ACT
2 To authorize and provide for the transfer of certain public property; to authorize the
3 exchange of certain public property in Avoyelles Parish; to provide for the property
4 description; to provide for reservation of mineral rights; to provide terms and
5 conditions; to provide for an effective date; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1.   The board of commissioners of the Red River, Atchafalaya, and Bayou
11 Boeuf Levee District, notwithstanding any other provision of law to the contrary, is hereby
12 authorized and empowered to convey, transfer, assign, lease, or deliver any interest,
13 excluding mineral rights, the district may have in and to all or any portion of the following
14 described property to Wade Bordelon:
15 A certain tract or parcel of land, together with all buildings, improvements, right of
16 ways, and privileges thereunto appertaining and being situated in Section 4,
17 T1N-R6E, Avoyelles Parish, Louisiana and being more particularly described wit:

19 Proposed Tract 2
20 Point of COMMENCEMENT being a found ½" iron rod on the East bank of
21 R.R.A.B.B. Levee District Borrow Pit at the Northwest corner of Proposed Tract 1;
22 thence along the North boundary line of Proposed Tract 1, N89°29'23"E, a distance
23 of 159.47 feet to a survey point from MML&H Survey; thence along the East
24 boundary line of Proposed Tract 1, S18°20'06"W, a distance of 1538.86 feet to a
25 survey point from MML&H Survey being the POINT OF BEGINNING; thence
26 along the North boundary line of tract herein described, S27°00'36"E, a distance of
27 211.77 feet to a survey point from MML&H Survey; thence along the East boundary
28 line of tract herein described.  S29°29'27"W, a distance of 103.83 feet to a survey
29 point; thence along the South boundary line of tract herein described, N69°05'07"W,
30 a distance of 127.30 feet to a survey point; thence along the East boundary line of
31 R.R.A.B.B. Levee District property, N17°32'41"E, a distance of 245.00 feet back the
32 POINT OF BEGINNING and containing 0.57 Acres +/-.  Said property being shown
33 as Proposed Tract 2 on Plat Survey by Jared A. Couvillion, Professional Land
34 Surveyor, dated June 6, 2018.

1 Section 2.  In exchange for the above described Proposed Tract 2 in Section 1 of this
2 Act, the board of commissioners of the Red River, Atchafalaya, and Bayou Boeuf Levee
3 District, notwithstanding any other provision of law to the contrary, is hereby authorized and
4 empowered to accept, in addition to any other consideration, delivery of title to all or any
5 portion of the following described property from Wade Bordelon:
6 A certain tract or parcel of land, together with all buildings, improvements, right of
7 ways, and privileges thereunto appertaining and being situated in Section 4,
8 T1N-R6E, Avoyelles Parish, Louisiana and being more particularly described wit: 
9 Proposed Tract 1:
10 Point of BEGINNING being a found ½" iron rod on the East bank of R.R.A.B.B.
11 Levee District Borrow Pit at the Northwest corner of tract herein described; thence
12 along the North boundary line of tract herein described, N89°29'23"E, a distance of
13 159.47 feet to a survey point from MML&H Survey; thence along the East boundary
14 line of tract herein described, S18°20'06"W, a distance of 1538.86 feet to a survey
15 point from MML&H Survey; thence along the East boundary line of R.R.A.B.B.
16 Levee District property the following 2 calls: N17°32'41"E, a distance of 1252.09
17 feet back to the POINT OF BEGINNING and containing 2.30 Acres  +/-. Said
18 property being shown as Proposed Tract 1 on Plat of Survey by Jared A. Couvillion,
19 Professional Land Surveyor, dated June 6, 2018. 
20 Section 3.  The Red River, Atchafalaya, and Bayou Beouf Levee District, is hereby
21 authorized to enter into such agreements, covenants, conditions, and stipulations and to
22 execute such documents as are necessary to properly effectuate any exchange, conveyance,
23 transfer, assignment, lease, or delivery of title, excluding mineral rights, to the property
24 described as Proposed Tract 2 in Section 1 of this Act, and as more specifically described
25 in any such agreements entered into and documents executed by and between the Red River,
26 Atchafalaya, and Bayou Beouf Levee District and Wade Bordelon.
27 Section 4.  The board of commissioners of the Red River, Atchafalaya, and Bayou
28 Boeuf Levee District, notwithstanding any other provision of law to the contrary, is hereby
29 authorized and empowered to convey, transfer, assign, lease, or deliver any interest,
30 excluding mineral rights, the district may have in and to all or any portion of the following
31 described property to Cutoff Properties, LLC:
32 A certain tract or parcel of land containing approximately 120 acres and being the
33 West Half of the Northwest Quarter (W/2 of NW/4) and the Southeast Quarter of the
34 Northwest Quarter (SE/4 of NW/4) of Section 1, Township 1 South, Range 6 East,
35 Avoyelles Parish.  
36 Section 5.  In exchange for the above described tract in Section 4 of this Act, the
37 board of commissioners of the Red River, Atchafalaya, and Bayou Boeuf Levee District,
38 notwithstanding any other provision of law to the contrary, is hereby authorized and

1 empowered to accept, in addition to any other consideration, delivery of title to all or any
2 portion of the following described property, including all predial servitudes and rights of
3 way, from Cutoff Properties, LLC:
4 A 140 acre portion of the following described tract:
5 A certain tract or parcel of land with all timber, buildings and improvements thereon,
6 containing 200 acres, more or less, situated, lying and being in TIS, R6E, 7th Ward
7 of Avoyelles Parish, Louisiana, being the North Half of the Southwest Quarter, and
8 the Southwest Quarter of the Southwest Quarter of Section 29, and the North Half
9 of the Southeast Quarter of Section 30, bounded North by Heartwood Forestland
10 Fund VIII Limited Partnership, South and East by Heartwood Forestland Fund VIII
11 Limited Partnership and Red River, Atchafalaya and Bayou Boeuf Levee District and
12 West by Wayne Joseph Lemoine and Heartwood Forestland Fund VIII Limited
13 Partnership.
14 Section 6.  The Red River, Atchafalaya, and Bayou Beouf Levee District, is hereby
15 authorized to enter into such agreements, covenants, conditions, and stipulations and to
16 execute such documents as are necessary to properly effectuate any exchange, conveyance,
17 transfer, assignment, lease, or delivery of title, excluding mineral rights, to the property
18 described in Section 4 of this Act, and as more specifically described in any such agreements
19 entered into and documents executed by and between the Red River, Atchafalaya, and 
20 Bayou Beouf Levee District and Cutoff Properties, LLC. 
21 Section 7.  This Act shall become effective upon signature by the governor or, if not
22 signed by the governor, upon expiration of the time for bills to become law without signature
23 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
24 vetoed by the governor and subsequently approved by the legislature, this Act shall become
25 effective on the day following such approval.
