Subpart E of Part IV of Subchapter A of Chapter 5-D of Title 40 of the 9Louisiana Revised Statutes of 1950, comprised of 40:1177.1, is hereby enacted to read as 10follows: 11 SUBPART E. RIGHT TO MEDICATION ACCESS BY HOSPITAL PATIENTS 12 ยง1177.1. Request for medication; emergency privilege 13 A. Notwithstanding any provision of law to the contrary, any person with 14 medical power of attorney who requests a hospital staff member to administer any 15 particular medication shall be granted emergency privilege and access to a physician 16 within twenty-four hours of the request for the sole and limited purpose of 17 administering the requested medication. 18 B. Any hospital that acts in accordance with the provisions of Subsection A 19 of this Section shall not be held liable for any harm to a patient resulting from the 20 administration of the requested medication. Proposed law provides that any person with medical power of attorney who requests a hospital staff member to administer any particular medication shall be granted emergency privilege and access to a physician. Proposed law requires that access to a physician be provided within 24 hours of the request for the administration of medication. Proposed law states that the physician shall be requested for the sole and limited purpose of administering the requested medication. Proposed law provides that hospitals that act in accordance with provisions of proposed law shall not be held liable for any harm to a patient resulting from the administration of the requested medication.
