HOUSE BILL NO. 482

SECONDHAND DEALERS:  Provides with respect to the purchase of catalytic converters
1	AN ACT
2To amend and reenact R.S. 37:1970(C)(2) and to enact R.S. 37:1970(E), relative to the sale
3 of catalytic converters; to require documents of origin; to provide penalties; to make
4 technical changes; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 37:1970(C)(2) is hereby amended and reenacted and R.S. 37:1970(E)
7is hereby enacted to read as follows:
8 ยง1970.  Statement by seller required; failure to exact statement evidence of
9	fraudulent intent; documents of origin for catalytic converters; exoneration
10	from criminal knowledge; penalties

14	(2)(a)  The statement shall include the name of the company or governmental
15 entity consenting to the sale and the name, employee number, and phone number of
16 the person signing the statement authorizing the sale. The operator shall attempt to
17 verify the authenticity of the statement authorizing the sale of the materials. The
18 statement shall be retained by the operator.
19	(b) In addition to the statements required in Subsection A of this Section and
20 Subparagraph (a) of this Paragraph, an operator shall require a person attempting to

1 sell a catalytic converter to provide documents of origin sufficient to prove that the
2 catalytic converter is not stolen property.

4	E.  An operator who violates the provisions of Subsection C of this Section
5 shall be fined not less than five hundred dollars, imprisoned no more than one year,
6 or both, for each violation.

Abstract:  Requires an operator of a scrap metal recycling facility (operator) to obtain
documents of origin when purchasing a catalytic converter. 
Present law requires an operator to collect certain information and documentation from a
person selling materials to the operator.
Proposed law retains present law and adds additional requirements when the person is selling
a catalytic converter to the operator, specifically requiring the operator to obtain documents
of origin sufficient to prove that the catalytic converter is not stolen property.
If an operator violates the provisions of proposed law, he shall be fined not less than $500,
be imprisoned for not more than one year, or both.
