1	AN ACT
2 To amend and reenact R.S. 40:1250.31(A)(1), relative to the medical assistance program of
3 this state known as Medicaid; to provide for Medicaid coverage of dental care for
4 certain persons with developmental or intellectual disabilities; to extend Medicaid
5 coverage for dental care to certain Medicaid enrollees who reside in intermediate
6 care facilities for people with developmental disabilities; to provide for an effective
7 date; and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 40:1250.31(A)(1) is hereby amended and reenacted to read as
10 follows:
11 ยง1250.31.  Dental care for certain adults with developmental or intellectual
12	disabilities; Medicaid coverage required
13	A.(1)  The Louisiana Department of Health shall ensure that comprehensive
14 Medicaid coverage for dental care is provided to all of the following persons:
15	(a)  Each each person of age twenty-one or older who is enrolled in any
16 Medicaid waiver program for persons with developmental or intellectual disabilities.
17	(b)  Each Medicaid enrollee of age twenty-one or older who resides in an
18 intermediate care facility for people with developmental disabilities licensed in
19 accordance with the provisions of R.S. 40:2180 et seq.

1 Section 2.  The provisions of Section 1 of this Act shall become effective when an
2 Act of the Louisiana Legislature containing a specific appropriation of monies for the
3 implementation of the provisions of this Act becomes effective.
4 Section 3.  The provisions of Sections 2 and 3 of this Act shall become effective
5 upon signature by the governor or, if not signed by the governor, upon expiration of the time
6 for bills to become law without signature by the governor, as provided by Article III, Section
7 18 of the Constitution of Louisiana.  If vetoed by the governor and subsequently approved
8 by the legislature, Sections 2 and 3 of this Act shall become effective on the day following
9 such approval.
