HOUSE BILL NO. 552

VOTING/REGISTRATION:  Provides relative to personal identification for electronic voter
registration
1	AN ACT
2To amend and reenact R.S. 18:103(A) and 115.1(A) and (C)(2) and (4)(a), relative to
3 electronic voter registration; to provide for accepted means of identification for such
4 registration; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 18:103(A) and 115.1(A) and (C)(2) and (4)(a) are hereby amended
7and reenacted to read as follows:
8 §103.  Personal appearance of applicant required; exceptions
9	A.  Except as otherwise specifically provided by law, any person who meets
10 the qualifications for voter registration and desires to register as an elector shall
11 apply to do so by making application in person to a registrar or deputy registrar of
12 the parish in which he seeks to register, by submission of the federal postcard
13 application form as authorized in this Code, by application through the Department
14 of Public Safety and Corrections, by application through designated voter
15 registration agencies, electronically on the secretary of state's website if the person
16 has a valid Louisiana driver's license REAL ID issued pursuant to R.S. 40:1321(P)
17 or Louisiana special identification card issued pursuant to R.S. 40:1321 40:1321(A),
18 or by mail using the national mail voter registration form as promulgated by the
19 United States Election Assistance Commission, the state mail voter registration form,
20 or a computer-generated form thereof containing the same requests for information

1 as prescribed by R.S. 18:104 or as contained on the national mail voter registration
2 form.

4 §115.1.  Electronic registration
5	A.  A person who has a valid Louisiana driver's license REAL ID issued
6 pursuant to R.S. 40:1321(P) or Louisiana special identification card issued pursuant
7 to R.S. 40:1321 40:1321(A) may apply to register to vote or make changes to his
8 existing registration by completing and submitting an electronic voter registration
9 application on the secretary of state's website.

13	(2)  The applicant shall assent to the use of his Louisiana driver's license
14 REAL ID or Louisiana special identification card signature for voter registration
15 purposes.

17	(4)(a)  Immediately upon submission of the application, the information
18 submitted by the applicant shall be checked to ensure that the Louisiana driver's
19 license REAL ID number or Louisiana special identification card number submitted
20 by the applicant matches the information maintained by the Department of Public
21 Safety and Corrections.

Present law provides that the Dept. of Public Safety and Corrections, office of motor
vehicles, shall issue an identification card that is compliant with federal law known as the
REAL ID Act.  Requires that a person meet requirements of the U.S. Dept of Homeland
Security to receive a REAL ID.
Proposed law requires that a person have a REAL ID, rather than a driver's license, in order
to register to vote electronically.  Otherwise retains present law.
