HOUSE BILL NO. 660

DISTRICT ATTORNEYS:  (Constitutional Amendment) Requires district attorneys to retire
at age 70
1	A JOINT RESOLUTION
2Proposing to amend Article V, Section 26(A) and to add Article V, Section 26(D) of the
3 Constitution of Louisiana, relative to district attorneys; to require district attorneys
4 to retire at age seventy; to provide for submission of the proposed amendment to the
5 electors; and to provide for related matters.
6 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
7elected to each house concurring, that there shall be submitted to the electors of the state of
8Louisiana, for their approval or rejection in the manner provided by law, a proposal to
9amend Article V, Section 26(A) and to add Article V, Section 26(D) of the Constitution of
10Louisiana, to read as follows:
11 §26. District Attorneys
12	Section 26.(A)  Election; Qualifications; Assistants. In each judicial district
13 a district attorney shall be elected for a term of six years, except as otherwise
14 provided in this Section.  He shall have been admitted to the practice of law in the
15 state for at least five years prior to his election and shall have resided in the district
16 for the two years preceding election.  A district attorney may select assistants as
17 authorized by law, and other personnel.

19	(D)  Mandatory Retirement.  Except as otherwise provided in this Section,
20 any district attorney having attained his seventieth birthday while in office shall be

1 mandatorily retired as of that date and shall not complete that term of office.  Any
2 district attorney over the age of seventy shall be allowed to serve until his next
3 birthday and shall then be mandatorily retired as of that date.
4 Section 2.  Be it further resolved that this proposed amendment shall be submitted
5to the electors of the state of Louisiana at the statewide election to be held on November 8,
62022.
7 Section 3.  Be it further resolved that on the official ballot to be used at the election,
8there shall be printed a proposition, upon which the electors of the state shall be permitted
9to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
10follows:
11	Do you support an amendment to provide for a mandatory retirement age of
12	seventy years for district attorneys? (Amends Article V, Section 26(A), Adds
13	Article V, Section 26(D))

Abstract: Requires mandatory retirement of district attorneys who reach 70 years of age.
Present constitution provides that in each judicial district a district attorney shall be elected
for a term of six years.
Proposed constitutional amendment requires district attorneys to retire at 70 years of age.
Allows any district attorney who is currently in office and over 70 years of age to serve until
his next birthday. 
Provides for submission of the proposed amendment to the voters at the statewide election
to be held November 8, 2022.
