ENROLLED ACT No. 497 2022 Regular Session HOUSE BILL NO. 755 BY REPRESENTATIVES SCHEXNAYDER, BUTLER, HORTON, LACOMBE, MCFARLAND, CHARLES OWEN, RISER, SCHAMERHORN, THOMPSON, AND ZERINGUE 1 AN ACT 2 To amend and reenact R.S. 39:100.44.1(B)(4), (D), (E), (H)(3), and (J), and to enact R.S. 3 39:100.44.1(K) and Subpart Y of Part II-A of Chapter 1 of Subtitle I of Title 39 of 4 the Louisiana Revised Statutes of 1950, to be comprised of R.S. 39:100.192, relative 5 to the disbursement of state monies; to provide with respect to monies received from 6 the American Rescue Plan Act of 2021; to provide for creation of certain funds for 7 a program to assist political subdivisions in securing federal grants; to make changes 8 to the Louisiana Loggers Relief Program; to make changes to the Louisiana Save 9 Our Screens Program; to provide for an effective date; and to provide for related 10 matters. 11 Be it enacted by the Legislature of Louisiana: 12 Section 1. R.S. 39:100.44.1(B)(4), (D), (E), (H)(3), and (J) are hereby amended and 13 reenacted to read as follows: 14 §100.44.1. Louisiana Main Street Recovery Program; Louisiana Rescue Plan Funds; 15 Loggers Relief; Save Our Screens 16 * * * 17 B. Any business receiving funding from a program within the Louisiana 18 Main Street Recovery Program pursuant to this Section shall meet the following 19 criteria: 20 * * * Page 1 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 755 ENROLLED 1 (4)(a) For movie theaters, experienced Experienced a revenue loss of ten 2 percent or greater of gross revenue for the period of January 1, 2020, through 3 December 31, 2020, as compared to the gross revenue of the business during the 4 same period in 2019. 5 (b) For loggers, experienced a revenue loss of gross revenue for the period 6 of January 1, 2020, through December 31, 2020, as compared to the gross revenue 7 of the business during the same period in 2019. 8 * * * 9 D.(1) Priority shall be given to businesses that previously submitted 10 applications to the Louisiana Main Street Recovery Program as provided in R.S. 11 39:100.44 but whose applications were not considered due to exhaustion of monies 12 in the Louisiana Main Street Recovery Fund. 13 (2) Notwithstanding the provisions of Paragraph (1) of this Subsection, 14 priority shall be given to timber harvesting and timber handling businesses that 15 previously submitted applications to the Louisiana Main Street Recovery Program 16 as provided in R.S. 39:100.44 but whose applications were denied. 17 E.(1) The Louisiana Loggers Relief Program shall have priority for ten 18 million dollars of the money granted by the Louisiana Main Street Recovery 19 Program. 20 (2) Grants shall be distributed to eligible timber harvesting and timber 21 hauling businesses impacted by COVID-19. Any grant received pursuant to this 22 Subsection shall not exceed twenty-five thousand dollars per business. In addition 23 to the criteria provided in Subsection B of this Section, a timber harvesting or timber 24 hauling business shall meet all of the following criteria to be eligible to receive a 25 grant: 26 (1) (a) Is assigned a North American Industry Classification System Code 27 of 113310 or 484220. classified as one of the following Internal Revenue Service 28 Principal Business Activity Codes: 29 (i) 113000, 113110, 113210, 113310, or 115310. 30 (ii) 484110, 484120, 484200, or 484220. HB NO. 755 ENROLLED 1 (2) (b) Is certified by the Louisiana Forestry Association as a master logger. 2 headquartered in Louisiana. 3 (3) (c) Is not a subsidiary of a business with more than fifty full-time 4 equivalent employees, is not part of a larger business enterprise with more than fifty 5 full-time equivalent employees, and is not owned by a business with more than fifty 6 full-time equivalent employees. 7 * * * 8 H. 9 * * * 10 (3) Any remaining balance in the fund on June 30, 2022 June 30, 2023, shall 11 be transferred to the Louisiana Rescue Plan Fund. 12 * * * 13 J.(1) For the Louisiana Loggers Relief Program, no No grants shall be 14 awarded pursuant to this Section after January 30, 2022. December 31, 2022. 15 (2) For the Louisiana Save Our Screens Program, no grants shall be awarded 16 pursuant to Subsection F of this Section after January 30, 2022. In the event that 17 monies allocated in the Louisiana Main Street Recovery Rescue Plan Fund for the 18 Louisiana Save Our Screens Program are available after January 30, 2022, 19 supplemental grants shall be awarded on a pro-rata, per-screen basis to all movie 20 theater businesses that applied for a grant on or before January 30, 2022. For the 21 Louisiana Save Our Screens Program, no supplemental grants shall be awarded 22 pursuant to this Subsection after December 31, 2022. 23 Section 2. R.S. 39:100.44.1(K) is hereby enacted to read as follows: 24 §100.44.1. Louisiana Main Street Recovery Program; Louisiana Rescue Plan Funds; 25 Loggers Relief; Save Our Screens 26 * * * 27 K. Notwithstanding any other provision of this Section to the contrary, three 28 million dollars from the money granted to the Louisiana Loggers Relief Program 29 pursuant to Paragraph (E)(1) of this Section shall be deposited into the Louisiana 30 Agriculture Transportation Group Self-Insured Fund in furtherance of supply chain Page 3 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 755 ENROLLED 1 resiliency and the remaining money allocated to the Louisiana Loggers Relief 2 Program shall be granted pursuant to the requirements provided in Paragraph (E)(2) 3 of this Section. 4 Section 3. Subpart Y of Part II-A of Chapter 1 of Subtitle I of Title 39 of the 5 Louisiana Revised Statutes of 1950, comprised of R.S. 39:100.192 is hereby enacted to read 6 as follows: 7 SUBPART Y. POLITICAL SUBDIVISION FEDERAL GRANT ASSISTANCE FUND 8 §100.192. Political Subdivision Federal Grant Assistance Fund 9 A. There is hereby created in the state treasury, as a special fund, the Political 10 Subdivision Federal Grant Assistance Fund, hereafter referred to in this Section as 11 the "fund". After allocation of money to the Bond Security and Redemption Fund as 12 provided in Article VII, Section 9(B) of the Constitution of Louisiana, the treasurer 13 shall deposit in and credit to the fund all monies appropriated, transferred, or donated 14 for the fund. Monies in the fund shall be invested in the same manner as state general 15 fund monies and interest earned on investment of monies in the fund shall be 16 credited to the fund. Unexpended and unencumbered monies in the fund at the end 17 of the fiscal year shall remain in the fund. 18 B. Monies out of the fund shall be appropriated to the Division of 19 Administration via the process to adjust an agency's appropriation as provided for 20 in Section 2.A. of the Act that originated as House Bill No. 1 of the 2022 Regular 21 Session of the Legislature. 22 C. The fund shall be used for the administration of a program to assist 23 political subdivisions with competitive federal grant opportunities made pursuant to 24 the Infrastructure Investment and Jobs Acts (P.L. 117-58). 25 D. The program’s guidelines shall be subject to approval by the Joint 26 Legislative Committee on the Budget. 27 Section 4.(A) Prior to June 30, 2022, the state treasurer is hereby authorized and 28 directed to transfer four hundred ninety-seven thousand two hundred sixty-six dollars from 29 the Louisiana Rescue Plan Fund into the Louisiana Main Street Recovery Rescue Plan Fund 30 for the Louisiana Save Our Screens Program. HB NO. 755 ENROLLED 1 (B) Prior to June 30, 2022, the state treasurer is hereby authorized and directed to 2 transfer twenty-five million dollars from the Capital Outlay Savings Fund into the Political 3 Subdivision Federal Grant Assistance Fund. 4 Section 5. The provisions of Section 2 of this Act shall take effect and become 5 operative if and when the Act which originated as Senate Bill No. 437 of the 2022 Regular 6 Session of the Legislature is enacted and becomes effective. 7 Section 6. The provisions of Sections 1, 3, 4, 5, and 6 of this Act shall become 8 effective upon signature by the governor or, if not signed by the governor, upon expiration 9 of the time for bills to become law without signature by the governor, as provided by Article 10 III, Section 18 of the Constitution of Louisiana. If vetoed by the governor and subsequently 11 approved by the legislature, the provisions of Sections 1, 3, 4, 5, and 6 of this Act shall 12 become effective on the day following such approval.
