HOUSE BILL NO. 913

GAMBLING/RIVERBOAT:  Provides relative to elections for riverboat gaming
1	AN ACT
2To enact R.S. 18:1300.22(C), relative to gaming elections; to provide relative to elections
3 for riverboat gaming; to provide relative to elections when voters do not approve a
4 proposition for riverboat gaming; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 18:1300.22(C) is hereby enacted to read as follows: 
7 §1300.22.  Calling of gaming elections as required by the constitution

9	C.  In any parish in which a referendum election is called by the governing
10 authority and a majority of the electors do not approve the proposition for riverboat
11 gaming, no subsequent referendum election for riverboat gaming shall be called in
12 the same parish at any time.

Abstract:  Provides relative to referendum elections for riverboat gaming when a majority
of electors do not approve a proposition for riverboat gaming.
Present law provides that any election required by present constitution (Art. XII, §6) may
be called only by an enactment of the legislature which specifically authorizes such election.

Present law further provides that if the election is required by present constitution, then such
election may be called either by law or by the adoption of a resolution or ordinance of the
governing authority of the parish in which the election would be required provided the
license to conduct riverboat gaming has been approved by the La. Gaming Control Bd. prior
to the authorization for the election. 
Proposed law retains present law and provides that in any parish in which a referendum
election is called by the governing authority and a majority of the electors do not approve
the proposition for riverboat gaming, no subsequent referendum election for riverboat
gaming shall be called in the same parish at any time.
