HOUSE BILL NO. 975

WATER/RESOURCES:  Provides relative to the capital area groundwater conservation
district
1	AN ACT
2To amend and reenact R.S. 38:3074(A)(6), (7), (8), and (9), (C), and (E) and to enact R.S.
3 38:3074(F), relative to the capital area groundwater conservation district; to modify
4 members of the board of commissioners; to increase the term limits of
5 commissioners; to provide for partial terms limits; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 38:3074(A)(6), (7), (8), and (9), (C), and (E) are hereby amended and
8reenacted and R.S. 38:3074(F) is hereby enacted to read as follows:
9 ยง3074.  Board of commissioners; appointments; tenure; replacement; compensation
10	A.  Members of the board of commissioners shall be appointed by the
11 governor.  Each appointment by the governor shall be submitted to the Senate for
12 confirmation.  The members shall be appointed as follows:

14	(6)  One member shall be appointed from nominations by the Louisiana Farm
15 Bureau Federation and the Louisiana Cattlemen's Association.
16	(7)(6)  One member shall be the secretary of the Department of
17 Environmental Quality, or his designee, who shall be a member of his staff and be
18 a professional geologist licensed by the Louisiana Board of Professional
19 Geoscientists or be a registered professional engineer with experience in

1 groundwater resource management or a person with experience in groundwater
2 resource management.
3	(8)(7)  One member shall be appointed from a nomination by the mayor-
4 president of East Baton Rouge Parish who shall be a professional geologist licensed
5 by the Louisiana Board of Professional Geoscientists or a registered professional
6 engineer with experience in groundwater resource management or a person with
7 experience in groundwater resource management.
8	(9)(8)  One member shall be appointed by the governor from nominations
9 submitted by the majority vote of the members of the board.  The member shall be
10 a professional geologist licensed by the Louisiana Board of Professional
11 Geoscientists or a technical professional with experience in groundwater resource
12 management who is licensed by the Louisiana Professional Engineering Board or a
13 person with experience in groundwater resource management.  For the purposes of
14 this Paragraph "board" shall mean the members appointed pursuant to Paragraphs (1)
15 through (8)(7) of this Subsection.

17	C.  No commissioner shall be entitled to serve more than two three
18 consecutive regular terms, with the exception of members representing governmental
19 entities.  Terms shall commence for those initially appointed on the date of
20 implementation of the district.  Terms for commissioners subsequently elected shall
21 commence on the anniversary date of the date of implementation.

23	E.  A commissioner that is appointed to fill an unexpired term shall be
24 eligible to serve consecutively no more than three full terms.
25	E. F.  Commissioners shall not be compensated for their services, except that
26 the board may, by regulation, provide for the payment of expenses for travel outside
27 the district on official business.

Abstract:  Modifies the composition of the board of commissioners of the capital area
groundwater conservation district and the term limits of commissioners.
Present law provides the appointments of the board of commissioners of the capital area
groundwater conservation district.
Present law provides for the appointment of 13 members of the board of commissioners.
Proposed law modifies present law by reducing the appointments from 13 to 12 and removes
one member appointed from nominations by the La. Farm Bureau Federation and the La.
Cattlemen's Association.
Present law prohibits commissioners from serving more than two consecutive regular terms,
with the exception of members representing governmental entities.
Proposed law modifies present law by increasing the number of consecutive regular terms
from two to three.
Proposed law specifies that a commissioner that is appointed to fill an unexpired term is
eligible to serve consecutively no more than three full terms.
