HOUSE RESOLUTION NO. 268

A RESOLUTION
To urge and request the Louisiana State Police to work in conjunction with the Louisiana
office of motor vehicles, the Louisiana Department of Transportation and
Development, the Louisiana Automobile Dealers Association, and the Louisiana
Motor Transport Association to study the feasibility of updating the process and
applicable fees for the inspection of commercial motor vehicles required to be
inspected under the provisions of federal regulations.
WHEREAS, R.S. 32:1306(C)(5) provides for the operation of official inspection
stations and provides in pertinent part for the fees charged for the inspection of all
commercial motor vehicles required to be inspected under the provisions of Part 396 of Title
49 of the Code of Federal Regulations, including Part 396.17 and "Appendix G" thereof; and
WHEREAS, R.S. 32:1306(C)(5) also provides, in pertinent part, that the Legislature
of Louisiana declares that a commercial motor vehicle inspection is much more extensive
than state inspections and that the increase in the fee or charge for the inspection of
commercial vehicles is based on the difference in the two types of inspections; and
WHEREAS, although the Legislature of Louisiana has recognized that the extensive
inspection involved in a federal inspection of a commercial motor vehicle mandates an
increase in fees compared to the state inspection of a commercial motor vehicle, there is no
standard fee established for the inspection, causing fewer stations to offer federal
inspections; and
WHEREAS, R.S. 32:1311(E)(2) authorizes the owner or operator of a commercial
motor vehicle, truck, or tractor to obtain a Louisiana commercial motor vehicle inspection
certificate to satisfy the requirements of federal regulations as an alternate means of

compliance, yet with fewer stations offering the federal inspection, there are ongoing issues
with the option to purchase either inspection and a select group of commercial motor 
vehicles that receive citations for failure to have the federal inspection.
THEREFORE, BE IT RESOLVED that the House of Representatives of the
Legislature of Louisiana does hereby urge and request the Louisiana State Police to work in
conjunction with the Louisiana office of motor vehicles, the Louisiana Department of
Transportation and Development, and the Louisiana Motor Transport Association to study
the feasibility of updating the process and applicable fees for the inspection of all
commercial motor vehicles required to be inspected under the provisions of Part 396 of Title
49 of the Code of Federal Regulations, including Part 396.17.
BE IT FURTHER RESOLVED that the Louisiana State Police, in conjunction with
the Louisiana office of motor vehicles, the Louisiana Department of Transportation and
Development, the Louisiana Automobile Dealers Association, and the Louisiana Motor
Transport Association, shall submit a report detailing the results of its study to the House of
Representatives of the Legislature of Louisiana no later than February 1, 2023.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
secretary of the Louisiana State Police, the Louisiana office of motor vehicles, the Louisiana
Department of Transportation and Development, the chairman of the Louisiana Automobile
Dealers Association, and the Louisiana Motor Transport Association.
