SENATE BILL NO. 123

1	AN ACT
2 To authorize the use of certain state property in Cameron Parish for seafood research; to
3 provide relative to protecting the state's natural resources; to provide relative to the
4 use of certain waters for oyster farming research; to provide relative to the
5 specification of the boundaries and size of the areas in which the research will be
6 conducted; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. (A)  The Cameron Parish Port, Harbor, and Terminal District may use, in
9 accordance with this Act, the following described state water bottoms, water columns, and
10 water surfaces above the specified sections of water bottoms:
11	An area of approximately forty-eight acres in Calcasieu Lake, Cameron
12 Parish, Louisiana, circumscribed by lines connecting the following points (projection
13 in North American datum, 1983):
14 The Northeast corner is located at 29 degrees, 50 minutes, 51.09 seconds, North, 93
15 Degrees, 19 minutes, 56.80 seconds, West. The boundary shall then run south,
16 southeast from the northeast corner to a point 29 degrees, 50 minutes, 37.89 seconds,
17 North, 93 degrees, 19 minutes, 54.25 seconds, West, and from there to the southeast
18 corner located at 29 degrees, 50 minutes, 28.58 seconds, North, 93 degrees, 19
19 minutes, 50.74 seconds, West. From the southeast corner the boundary shall then run
20 to the southwest corner located at 29 degrees, 50 minutes, 24.37 seconds, North, 93
21 degrees, 19 minutes, 56.94 seconds, West. From the southwest corner the boundary
22 shall then run northwest to a point 29 degrees, 50 minutes, 29.15 seconds, North, 93
23 degrees, 20 minutes, 1.24 seconds, West, and from there to a north, northwest point
24 29 degrees, 50 seconds, 34.96 seconds, North, 93 degrees, 20 minutes, 3.90 seconds,
25 West, and from there to the northwest corner located at 29 degrees, 50 minutes,
26 47.73 seconds, North, 93 degrees, 20 minutes, 5.33 seconds, West. The boundary
27 then runs from the northwest corner to the northeast corner.
28 (B)  The Cameron Parish Port, Harbor, and Terminal District is authorized to use
29 such water bottoms, water columns, and water surfaces for the sole purpose of an off-bottom
30 oyster (Crassostrea Virginica) culture project undertaken in cooperation with the Louisiana
31 Sea Grant program subject to approval of all state and federal agencies with jurisdiction over
32 activities conducted in connection with the project.

1 Section 2.  The commissioner of administration, on behalf of the state of Louisiana,
2 and the Cameron Parish Port, Harbor, and Terminal District are hereby authorized to enter
3 into such agreements, covenants, conditions, and stipulations and to execute such documents
4 as necessary to properly effectuate the use of property described in Section 1(A) of this Act,
5 and as more specifically described in any such agreements entered into and documents
6 executed by and between the state and the Cameron Parish Port, Harbor, and Terminal
7 District. In determining appropriate compensation for the use of state property authorized
8 by this Act, the commissioner may consider potential economic development and other
9 benefits resulting from the farming contemplated.
10 Section 3.  This Act shall become effective upon signature by the governor or, if not
11 signed by the governor, upon expiration of the time for bills to become law without signature
12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
13 vetoed by the governor and subsequently approved by the legislature, this Act shall become
14 effective on the day following such approval.
