2022 Regular Session ENROLLED SENATE BILL NO. 368 BY SENATOR HARRIS AND REPRESENTATIVE DUPLESSIS 1 AN ACT 2 To amend and reenact R.S. 33:4882, relative to building and zoning regulations in parishes 3 and municipalities; to require that the governing authority of any municipality or 4 parish not allow and not cause any building or land to lose nonconforming use status 5 by reason of vacancy or cessation of normal operations during a specified time 6 period; and to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 33:4882 is hereby amended and reenacted to read as follows: 9 ยง4882. Building and zoning regulations in local governmental subdivisions; 10 nonconforming use 11 A. Notwithstanding any provision of law or municipal or parish ordinance or 12 resolution to the contrary, the governing authority of any municipality or parish and 13 any agency of any such municipality or parish shall not allow and shall not cause any 14 building or land to lose its nonconforming use status because, during all or part of 15 the period of August 29, 2005 March 11, 2020, through August 28, 2007 March 16, 16 2022, as a result of damage caused by Hurricane Katrina or Hurricane Rita, it is 17 temporarily vacant or operations normally carried on in such building or on such 18 land have been temporarily discontinued. 19 B. Notwithstanding the provisions of Subsection A of this Section, the 20 governing authority of any parish having a population in excess of four three 21 hundred fifty thousand, based on the latest federal decennial census, may by 22 ordinance reduce the time period of August 29, 2005 March 11, 2020, through 23 August 28, 2007 March 16, 2022, provided in Subsection A of this Section. This Act shall become effective upon signature by the governor or, if not 2 signed by the governor, upon expiration of the time for bills to become law without signature 3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 4 vetoed by the governor and subsequently approved by the legislature, this Act shall become 5 effective on the day following such approval.
