COURTS.  Provides relative to juror compensation rates. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 13:3049(B)(2)(a) and 3106, and to repeal R.S. 13:3049.1 and
3 3105, relative to juror compensation; to provide for the compensation rate of jurors
4 for attendance and mileage; to remove exceptions; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 13:3049(B)(2)(a) and 3106 are hereby amended and reenacted to read
7 as follows:

11	(2)(a) Except as provided by special law, the The jurors in civil cases who
12 attend may demand and receive fifty dollars for each day of attendance in court and
13 an amount equal to the rate in effect for state officials for each mile necessarily
14 traveled in going to and returning from the courthouse. Only one charge shall be
15 made for mileage each way. At the time of posting bond, the party praying for the
16 jury shall pay to the clerk of court the sum of one hundred and fifty dollars as jury
17 filing fees. In addition, prior to the commencement of the trial, the party praying for

1 the jury shall post a bond pursuant to Code of Civil Procedure Article 1734 or
2 deposit the amount ordered by the court pursuant to Code of Civil Procedure Article
3 1734.1. If the trial exceeds the estimated number of days, the party praying for the
4 jury shall post an additional bond or make an additional deposit as ordered by the
5 court. However, no party praying for a jury trial under the provisions of this
6 Subsection shall be required to pay any costs or advance deposit imposed under the
7 provisions of this Subsection if such has been waived or an order is rendered,
8 pursuant to Chapter 5 of Title I of Book IX of the Code of Civil Procedure,
9 permitting the applicant to litigate or continue to litigate without payment of such
10 costs or furnishing security therefor.

12 §3106. Provisions applicable to Orleans Parish 
13	The provisions of R.S. 13:3041, 3042, 3042.1, 3050, 3051, 3052, 3055, and
14 3056 shall apply to all parishes of the state, including Orleans Parish. The provisions
15 of R.S. 13:3043 through 3046, both inclusive, 3048, 3049, 3053 and 3054, shall have
16 no application to Orleans Parish.
17 Section 2. R.S. 13:3049.1 and 3105 are hereby repealed.
18 Section 3. This Act shall become effective upon signature by the governor or, if not
19 signed by the governor, upon expiration of the time for bills to become law without signature
20 by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If
21 vetoed by the governor and subsequently approved by the legislature, this Act shall become
22 effective on the day following such approval.

Present law provides that jurors in criminal cases may demand and receive $25 for each day
of attendance in court, and that mileage allowance shall be not less than 16¢ per mile nor
more than the rate in effect for state officials. Present law provides jurors in civil cases
receive $50 per day and one mileage charge equal to the rate in effect for state officials each
way. Present law also provides an exception for special laws. 
Proposed law retains present law but removes the exception for special laws.

Present law provides specials laws related to jurors summoned to serve in the 24th JDC. It
provides that jurors summoned to serve in criminal and civil cases shall receive
compensation of $25 for each day of attendance in court, and the mileage allowance shall
be not less than 16¢ per mile nor more than the rate in effect for state officials. Proposed law
repeals special law provisions.
Present law provides special laws related to jurors summoned to serve in civil cases in the
Civil District Court for Orleans Parish. It provides that jurors are entitled to compensation
of $25 each for each and every day, or part of a day, on which they serve as jurors in any
civil case. Proposed law repeals special law provisions.
Present law provides that present law providing for statewide juror compensation is not
applicable to Orleans Parish. Proposed law removes present law exception. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
