(2/3 - CA10s29(F)) (6/30/22) 1 AN ACT 2 To enact R.S. 11:710.2 and 1008, relative to the Teachers' Retirement System of Louisiana 3 and Louisiana School Employees' Retirement System; to provide relative to 4 reemployment of certain retirees in each retirement system; to provide relative to 5 terms and conditions of reemployment; to provide relative to earnings and retirement 6 benefits; to authorize reemployment without a suspension or reduction of benefits; 7 to provide requirements and limitations; to provide for an effective date; and to 8 provide for related matters. 9 Notice of intention to introduce this Act has been published. 10 Be it enacted by the Legislature of Louisiana: 11 Section 1. R.S. 11:710.2 and 1008 are hereby enacted to read as follows: 12 §710.2. Reemployment of certain retired teachers 13 A. Notwithstanding any provision of law to the contrary, any retiree of 14 this system reemployed pursuant to the provisions of this Section in a position 15 as a classroom teacher as defined by R.S. 11:710, or any system retiree 16 employed as a teacher's aide or a paraprofessional to assist any person in a 17 position as a classroom teacher shall be allowed to return to work immediately Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. During the period of reemployment, the retiree and his employer shall 3 make contributions to the retirement system as provided by this Chapter, but 4 the retiree shall receive no additional service credit and shall not accrue any 5 additional retirement benefits in the retirement system. Upon termination of 6 active service, the retiree shall, upon application, be refunded the employee 7 contributions paid since reemployment. The refund shall be without interest. 8 The retirement system shall retain the employer contributions. 9 C. The provisions of this Section shall be void on June 30, 2027. 10 * * * 11 §1008. Reemployment of certain retired school employees 12 A. Notwithstanding any provision to the contrary, any service retiree of 13 the Louisiana School Employees' Retirement System reemployed pursuant to 14 the provisions of this Section in any position covered by the system as a 15 full-time, part-time, temporary, or substitute employee, shall be allowed to 16 return to work immediately without suspension or reduction of his benefits 17 upon reemployment. 18 B. During the period of reemployment, the service retiree and his 19 employer shall make contributions to the retirement system as provided by this 20 Chapter, but the retiree shall receive no additional service credit and shall not 21 accrue any additional retirement benefits in the retirement system. This Act shall become effective on June 30, 2022; if vetoed by the 28 governor and subsequently approved by the legislature, this Act shall become effective on 29 the day following such approval by the legislature or June 30, 2022, whichever is later. Generally requires benefits to be suspended during reemployment. Allows payment of benefits to continue subject to certain requirements, in some cases, including an earnings limitation. Proposed law, relative to TRSL, provides that notwithstanding any provision to the contrary, any retiree reemployed pursuant to the provisions of proposed law in a position as a classroom teacher defined by present law, or someone employed as a teacher's aide or a paraprofessional to assist a classroom teacher shall be allowed to return to work immediately without suspension or reduction of his benefits upon reemployment. Requires payment of employer and employee contributions. Specifies the retiree receives no additional service credit and accrues no additional retirement benefits. Proposed law provides that upon termination of active service, the retired teacher shall, upon application, be refunded the employee contributions paid since reemployment. The refund is without interest. The retirement system retains the employer contributions. Proposed law relative to Louisiana School Employees' Retirement System (LSERS) provides that notwithstanding any provision to the contrary, any service retiree of LSERS reemployed pursuant to the provisions of proposed law in any position covered by the system as a full-time, part-time, temporary, or substitute employee, shall be allowed to return to work immediately without suspension or reduction of his benefits upon reemployment. Requires payment of employer and employee contributions. Specifies the retiree receives no additional service credit and accrues no additional retirement benefits in the retirement system. Proposed law provides that upon termination of active service, the service retiree shall, upon application, be refunded the employee contributions paid since reemployment. The refund is without interest. The retirement system retains the employer contributions. Proposed law provides that the provisions of proposed law shall be void on 6/30/27. Effective June 30, 2022.
