2022 Regular Session ENROLLED SENATE BILL NO. 436 BY SENATOR CLOUD 1 AN ACT 2 To enact R.S. 47:463.214, relative to motor vehicle special prestige license plate; to provide 3 for the establishment of the "Louisiana Equine Promotion and Research Advisory 4 Board" special prestige license plate; to provide for creation, issuance, design, fees, 5 distribution, and rule promulgation applicable to such license plates; to provide for 6 the Louisiana Equine Promotion and Research Advisory Board Special Prestige 7 License Plate Dedicated Fund Account; and to provide for related matters. 8 Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 47:463.214 is hereby enacted to read as follows: 10 ยง463.214. Special prestige license plate; "Louisiana Equine Promotion and 11 Research Advisory Board" 12 A.(1) The secretary of the Department of Public Safety and Corrections 13 shall establish a special prestige motor vehicle license plate to be known as the 14 "Equine Promotion" plate, provided there is a minimum of one thousand 15 applicants for such plate. The plate shall be restricted to use on passenger cars, 16 pickup trucks, recreational vehicles, motorcycles, and vans. 17 (2) The Department of Public Safety and Corrections, office of motor 18 vehicles, shall create the special prestige license plate when the applicable 19 statutory provisions are met and the department's electronic vehicle and title 20 registration system is updated to accommodate the creation of new plates. 21 B. The secretary shall work in conjunction with the chairman of the 22 Louisiana Equine Promotion and Research Advisory Board to select the color 23 and design of the plate, provided it is in compliance with R.S. 47:463(A)(3). The 24 design shall include the words "Equine Promotion". 25 C. SB NO. 436 ENROLLED 1 any citizen of Louisiana in the same manner as any other motor vehicle license 2 plate. 3 D. The department shall collect an annual royalty fee of twenty-five 4 dollars that shall be disbursed in accordance with Subsection E of this Section. 5 This fee shall be in addition to the standard motor vehicle license tax imposed 6 by Article VII, Section 5 of the Constitution of Louisiana, and a handling fee of 7 three dollars and fifty cents for each plate to be retained by the department to 8 offset a portion of administrative costs. 9 E. The annual royalty fee shall be collected by the department and 10 deposited into the Louisiana Equine Promotion and Research Advisory Board 11 Special Prestige License Plate Dedicated Fund Account. The money received 12 from the royalty fees shall be used to distribute grant funds as the Louisiana 13 Equine Promotion and Research Advisory Board so desires. 14 F. The secretary shall promulgate and adopt rules and regulations as are 15 necessary to implement the provisions of this Section. 16 G. There is hereby created, as a special statutorily dedicated fund 17 account within the state treasury, the Louisiana Equine Promotion and 18 Research Advisory Board Special Prestige License Plate Dedicated Fund 19 Account, hereafter referred to in this Subsection as the "account". 20 Notwithstanding any other provision of law, after compliance with the 21 requirements of Article VII, Section 9(B) of the Constitution of Louisiana 22 relative to the Bond Security and Redemption Fund, and after a sufficient 23 amount is allocated to pay all of the obligations secured by the full faith and 24 credit of the state which become due and payable within any fiscal year, the 25 treasurer shall pay an amount equal to the annual royalty fee collected by the 26 department into the account. All of the monies in the account shall be 27 appropriated each year by the legislature to the Louisiana Equine Promotion 28 and Research Advisory Board for application first to pay principal and interest 29 on any debt issued by the Louisiana Equine Promotion and Research Advisory 30 Board and second to pay any operating expenses of the Louisiana Equine Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Monies deposited into the account 2 shall be categorized as fees and self-generated revenue for the sole purpose of 3 reporting related to the executive budget, supporting documents, and general 4 appropriation bills and shall be available for annual appropriation by the 5 legislature.
