2022 Regular Session ENROLLED SENATE BILL NO. 477 BY SENATOR SMITH 1 AN ACT 2 To enact R.S. 32:387.2, relative to special permits; to establish a permit for the operation of 3 a combination of vehicles or tandem loads hauling containers to and from port 4 facilities; to provide for the adoption of administrative rules; to provide for terms, 5 conditions, requirements, and specifications; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:387.2 is hereby enacted to read as follows: 8 ยง387.2. Special permits; vehicles or tandem loads hauling divisible or 9 nondivisible container imports or exports to port facilities 10 A. Notwithstanding any provision of law to the contrary, the secretary 11 shall issue a biannual permit for the operation of a combination of vehicles or 12 tandem loads hauling divisible or nondivisible container imports or exports to 13 and from any port facility in the state, provided the combination of vehicles or 14 tandem loads meets all of the following requirements: 15 (1) Does not exceed one hundred forty thousand pounds gross weight. 16 (2) Does not exceed forty thousand pounds per tandem axle spread and 17 sixty thousand pounds per tridem axle spread as defined by the Department of 18 Transportation and Development. 19 (3) Does not exceed eighty-three feet in length. 20 (4) Is equipped with a dual-axle dolly and a dolly safety system with tilt 21 sensors attached to the dolly that provide feedback on tilt information to the 22 driver of the vehicle to ensure safe operations. 23 B. The permits and route via state and federal roadways, excluding the 24 interstate system, shall be issued at the truck permit office of the Department 25 of Transportation and Development. The secretary shall adopt rules in accordance with the Administrative 2 Procedure Act to implement the provisions of this Section. 3 D. The provisions of this Section and all legislative authority for the 4 existence of the permits authorized in this Section shall cease to exist on August 5 1, 2026. 6 Section 2. This Act shall become effective upon signature by the governor or, if not 7 signed by the governor, upon expiration of the time for bills to become law without signature 8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 9 vetoed by the governor and subsequently approved by the legislature, this Act shall become 10 effective on the day following such approval.
