HOUSE BILL NO. 36
BY REPRESENTATIVE TRAVIS JOHNSON
1	AN ACT
2 To amend and reenact R.S. 3:341(D) and 342(I) and to enact R.S. 3:342(J), relative to the
3 Delta Agriculture Research and Sustainability District; to provide for district
4 boundaries; to provide for personal immunity of board members; and to provide for
5 related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 3:341(D) and 342(I) are hereby amended and reenacted and R.S.
11 3:342(J) is hereby enacted to read as follows:
12 §341.  Delta Agriculture Research and Sustainability District; creation; purpose;
13	territorial jurisdiction

15	D.  The boundaries of the district shall be coterminous with the boundaries
16 of the parishes of Concordia, East Carroll, Madison, and Tensas.
17 §342.  Board of commissioners; members; officers; personal immunity
18	*          *          *
19	I.(1) The board shall hire a district director to manage the day-to-day
20 management operations of the district. The board shall establish the duties and

1 responsibilities and the salary and benefits for the position of district director. The
2 district director shall report directly to the board and, with approval of the board,
3 may hire an administrative assistant. 
4	(2) The district director, hired after July 1, 2023, must be a resident of the
5 state and have been domiciled in the district for the preceding two years prior to
6 employment. The provisions of this Paragraph shall not apply to the district director
7 employed prior to July 1, 2023.
8	J.  The board, its members, and its agents shall be immune from personal
9 liability for actions taken in good faith in the discharge of the board's responsibilities.
10 The state shall hold the board, its members, and its agents harmless from all costs,
11 damages, and attorney fees arising from claims and suits against them with respect
12 to matters to which such immunity applies.
