HOUSE BILL NO. 360
BY REPRESENTATIVE HODGES
LIBRARIES:  Provides relative to the membership of the Livingston Parish Library Board
of Control
1	AN ACT
2To enact R.S. 25:214.5, relative to Livingston Parish; to provide relative to the Livingston
3 Parish Library Board of Control; to provide for an increase in the membership of the
4 board; to provide relative to the appointment of board members; to provide for terms;
5 and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 25:214.5 is hereby enacted to read as follows:
11 ยง214.5.  Livingston Parish Library Board of Control; members; appointment; terms
12	of office
13	A.  Notwithstanding any other provision of law to the contrary, the governing
14 authority of the parish of Livingston shall appoint nine citizens to serve as the
15 members of the Livingston Parish Library Board of Control.  Each member of the
16 parish governing authority shall appoint one member to the board.  The president of
17 the parish governing authority shall be an ex officio member of the board.  However,
18 the president may designate another member of the parish governing authority to
19 serve in his stead on the library board of control.

1	B.  The appointed members of the library board of control shall serve five-
2 year terms after initial terms as provided in this Subsection.  One member shall serve
3 an initial term of one-year; two shall serve initial terms of two-years; two shall serve
4 initial terms of three-years; two shall serve initial terms of four-years; and two shall
5 serve initial terms of five-years, as determined by lot at the first meeting of the
6 library board of control.
7	C.  Vacancies occurring prior to the expiration of a term shall be filled in the
8 manner of the original appointment for the remainder of the unexpired term.
9	D.  Members are eligible for reappointment.
10 Section 2.  The terms of the members of the Livingston Parish Library Board of
11Control in office on the effective date of this Act shall terminate on the effective date of this
12Act; however, such members shall remain in office until at least five of the library board of
13control members who are appointed as provided in this Act take office.

Abstract:  Requires the governing authority of Livingston Parish to increase the
membership of the Livingston Parish Library Board of Control from seven to nine
members.
Present law authorizes parish and municipal governing authorities to create, by ordinance,
public libraries.  Requires parish and municipal governing authorities to create public
libraries when petitioned by not less than 25% of the duly qualified property taxpayers of
the respective parish or municipality.  Generally requires parish governing authorities to
appoint not less than five nor more than seven citizens of the parish as a board of control and
municipal governing authorities to appoint five citizens of the municipality as a board of
control.  Provides exceptions.  Provides that the president of the respective parish and the
mayor of the respective municipality are ex officio members of the board.  Provides that
members serve five-year staggered terms.
Proposed law provides an exception for the Livingston Parish Library Board of Control. 
Requires the parish governing authority to appoint nine citizens to serve as the members of
the library board of control.  Further requires each member of the parish governing authority
to appoint one member.  Provides that members are eligible for reappointment.  Proposed
law otherwise retains present law.
Proposed law provides that the terms of the members of the Livingston Parish Library Board
of Control in office on the effective date of proposed law terminate on that date, but

members must remain in office until at least five library board of control members who are
appointed as provided in proposed law and take office.
