ENROLLED ACT No. 449 2023 Regular Session HOUSE BILL NO. 406 BY REPRESENTATIVE MINCEY 1 AN ACT 2 To amend and reenact the heading of Part IV of Chapter 3 of Title 32 of the Louisiana 3 Revised Statutes of 1950 and to enact R.S. 32:481, relative to interstate flooding 4 mitigation; to require the Department of Transportation and Development to develop 5 flood mitigation methods for possible implementation along the Interstate 12 6 corridor in Livingston Parish; to require a report to include an analysis of practical 7 and cost-effective engineering methods used by other states including Texas, 8 projected costs associated with the methods, and projected construction timelines; 9 to require submission of a report detailing the comparative analysis of methods; to 10 provide an effective date; and to provide for related matters. 11 Be it enacted by the Legislature of Louisiana: 12 Section 1. The heading of Part IV of Chapter 3 of Title 32 of the Louisiana Revised 13 Statutes of 1950 is hereby amended and reenacted and R.S. 32:481 is hereby enacted to read 14 as follows: 15 PART IV. PASSING SCHOOL VEHICLES 16 INTERSTATE FLOODING MITIGATION 17 ยง481. Comprehensive engineering comparative analysis of flood mitigation 18 methods; Livingston Parish 19 A. The department shall develop a comparable cost analysis of engineering 20 methods to improve water drainage issues resulting from impediments to the natural 21 water flow, on the Interstate 12 corridor in Livingston Parish along existing median 22 walls which may additionally or alternatively include potential engineering solutions 23 as well as retrofitting the existing median walls to improve the natural water flow 24 along the Interstate 12 corridor. The comparable analysis of potential engineering solutions shall include 2 the following: 3 (1) Practical and cost-effective engineering methods and potential solutions 4 used by other states including but not limited to Texas. 5 (2) Projected costs associated with the potential solutions. 6 (3) Projected construction timelines for the potential solutions of the 7 methods used. 8 C. The department shall provide a report of the comparative analysis of 9 potential solutions including those used by other states and methods necessary for 10 implementation to the House Committee on Transportation, Highways and Public 11 Works and the Senate Committee on Transportation, Highways and Public Works, 12 not later than October 1, 2023. 13 Section 2. This Act shall become effective upon signature by the governor or, if not 14 signed by the governor, upon expiration of the time for bills to become law without signature 15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 16 vetoed by the governor and subsequently approved by the legislature, this Act shall become 17 effective on the day following such approval.
