MEDICAID:  Provides relative to Medicaid coverage for the Psychiatric Collaborative Care
Model
1	AN ACT
2To enact Part VII of Chapter 5-E of Title 40 of the Louisiana Revised Statutes of 1950, to
3 be comprised of R.S. 40:1259.1, relative to Medicaid coverage for mental health and
4 substance Medicaid recipients via the Psychiatric Collaborative Care Model; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  Part VII of Chapter 5-E of Title 40 of the Louisiana Revised Statutes of
81950, comprised of R.S. 40:1259.1, is hereby enacted to read as follows:
9 PART VII.  PSYCHIATRIC COLLABORATIVE CARE MODEL
10 ยง1259.1.  Psychiatric Collaborative Care Model; Medicaid coverage; service
11	delivery method requirements
12	A.  The state Medicaid program shall provide coverage for mental health and
13 substance abuse services that are delivered through evidence-based, integrated
14 behavioral healthcare models, such as the Psychiatric Collaborative Care Model.
15	B.(1)  Any medical necessity determination made for a recipient of Medicaid
16 services shall be in compliance with the provisions set forth in the Medicaid
17 program, as provided for in Title XIX of the Social Security Act, the Mental Health
18 Parity and Addiction Equity Act, and in accordance with the rules promulgated by
19 the Louisiana Department of Health.

1	(2)  The Louisiana Department of Health shall promulgate rules, in
2 accordance with the Administrative Procedure Act, as needed to comply with the
3 requirements set forth in this Section.  
4	C.  As used in this Section, the following terms have the meanings ascribed
5 to them:
6	(1)  "Medicaid" means the medical assistance program provided for in Title
7 XIX of the Social Security Act.
8	(2)  "Mental health or substance abuse services" means services for the
9 treatment of any condition or disorder that involves a mental health condition or
10 substance use disorder that falls under any of the diagnostic categories listed in the
11 mental disorders section of the current edition of the International Classification of
12 Diseases or that is listed in the mental disorders section of the most recent version
13 of the Diagnostic and Statistical Manual of Mental Disorders.
14	(3)  "Psychiatric Collaborative Care Model" means the evidence-based,
15 integrated behavioral health service delivery method that is typically provided by a
16 primary care team consisting of a primary care provider and a care manager who
17 works in collaboration with a psychiatric consultant, such as a psychiatrist.  Care is
18 directed by the primary care team and includes structured care management with
19 regular assessments of clinical status using validated tools and modification of
20 treatment as appropriate.  The psychiatric consultant provides regular consultations
21 to the primary care team to review the clinical status and care of patients and to make
22 recommendations.
23 Section 2.(A) The provisions of Section 1 of this Act shall become effective when
24an Act of the Louisiana Legislature containing a specific appropriation of monies for the
25implementation of the provisions of this Act becomes effective.
26 (B) The provisions of this Section become effective upon signature of the  governor
27or, if not signed by the governor, upon expiration of the time for bills to become law without
28signature by the governor, as provided in Article III, Section 18 of the Constitution of

1Louisiana.  If vetoed by the governor and subsequently approved by the legislature, the
2provisions of this Section shall become effective on the day following such approval.

Abstract:  Provides Medicaid coverage for mental health and substance abuse services via
the Psychiatric Collaborative Care Model. 
Proposed law requires Medicaid to provide coverage for mental health and substance abuse
services delivered through evidence-based, integrated behavioral healthcare models, such
as the Psychiatric Collaborative Care Model.
Proposed law requires any medical necessity determinations made for a recipient of
Medicaid services to comply with the provisions set forth in present law and the rules
promulgated by the La. Dept. of Health. 
Proposed law defines "Medicaid", "mental health or substance abuse services", and
"Psychiatric Collaborative Care Model".
Effective when an Act of the La. Legislature containing a specific appropriation of monies
for the implementation of the provisions of the proposed law becomes effective.
